Article 2 — Airport Operators and Lessees

§ 13.16.040. Purpose of municipal airport.

The municipal airport shall be conducted as a terminal facility for the promotion and accommodation of air commerce and shall be operated as a free public air terminal. (Ord. 1067 § 1)

§ 13.16.050. Hours of operation.

The airport shall be open for public use at all hours of the day, subject to such restrictions due to inclement weather, the condition of the landing area, the presentation of special events and like causes, as may be determined by the airport manager. (Ord. 1067 § 2)

§ 13.16.060. Special services and facilities—Restrictions on commercial…

Special services may be rendered or special facilities may be provided thereat on such terms as the city council may prescribe from time to time. No person shall use the airport as a base for the carrying on of commercial activities, for the carrying for hire of passengers, freight, express or mail, for instruction in aviation in any of its branches, for the sale of fuels, refreshments or any commodity or for any other commercial purposes, unless a permit has been granted therefor by the airport manager.

§ 13.16.070. User must obey all regulations.

The use of the airport or any of its facilities in any manner shall create an obligation on the part of the user thereof to obey all the regulations herein provided. (Ord. 1067 § 4)

§ 13.16.080. Responsibility of user.

The privilege of using the airport and its facilities shall be conditioned on the assumption of full responsibility and risk by the user thereof, and he or she shall release, hold harmless and indemnify the city, the city council, their officers, and employees from any liability or loss resulting from such use as well as against claims of third persons as against those of the person so using the airport. The exercise of the privilege of use shall constitute an acknowledgment that the city and the city council maintain the airport in a governmental capacity. (Ord. 1067 § 5)

§ 13.16.090. Air-traffic rules of Civil Aeronautics Authority adopted.

The air-traffic rules promulgated by the Civil Aeronautics Authority of the United States of America and presently in effect are hereby referred to, adopted and made a part of these regulations as fully in all respects as if particularly set forth herein. (Ord. 1067 § 6)

Authority—Exceptions.

No person, not properly certified by the Civil Aeronautics Authority, and no aircraft not similarly certified, shall operate on or over the airport; provided, that this restriction shall not apply to public aircraft belonging to the government of the United States or to a state, territory, possession or any political subdivision, nor to any aircraft of a foreign country operated under permission of the federal government.

§ 13.16.110. Compliance with rules and regulations of Civil Aeronautics Authority…

No person shall navigate any aircraft over, land upon or take-off from, or service, repair or maintain any aircraft on the airport or conduct any operation on or from the airport otherwise than in conformity with these rules and regulations and those of the Civil Aeronautics Authority. § 13.16.120. Registration required—Information to be given.

Every person stationed or employed at the airport or receiving instruction thereon or operating therefrom shall register at the office of the airport manager and shall state his or her name, address, telephone number and the nature of his or her business or occupation. (Ord. 1067 § 9)

§ 13.16.130. Handling, policing, and protection of public.

The airport manager shall have authority to take such steps as may be necessary for the handling, policing, and protection of the public while present at the airport, subject to the review of the city administrator.

§ 13.16.140. Unauthorized use of aircraft, accessories, tools, etc.

No person shall take or use any aircraft, parts or accessories thereof, or tools or other equipment owned or controlled by any other person and stored or otherwise left at the airport, without the consent of the owner or operator thereof, or other satisfactory evidence of his or her right so to do.

§ 13.16.150. Garbage, refuse, and rubbish disposal.

Each fixed base operator, tenant or user of the airport shall collect and dispose of all garbage, refuse and rubbish at his or her own cost and expense. (Ord. 1067 § 12)

§ 13.16.160. Requirements to lease property for business at airport.

The hereinafter set forth requirements shall be the minimum with respect to persons, partnerships or corporations seeking to lease property for conducting business or other operations upon such airport.

  • A. Lessee shall provide and maintain landscaping. Landscaping and landscaping areas shall be designated on the lease plot plans submitted to the city for city approval.

  • B. Lessee shall provide paving and other methods of dust control.

  • C. All buildings constructed on the site shall conform to the City of Oroville Municipal Code; shall be 430 square feet minimum in area, and shall conform to the requirements of Title 17, Zoning, and must be approved by the development review commission for architectural control.

  • D. The lessee shall provide the city with a financial statement together with such other information as may be requested relating to lessee's background, experience and overall capability in the conduct of such business as lessee may propose to engage in upon the airport.

§ 13.16.170. Minimum conditions to store, sell, or in other ways distribute fuel.

If the lessee proposes to construct the facilities for the conduct of a fixed base operation at the airport, and the lessee intends to store fuel and lubricants for his/her own use, or otherwise for the sale or distribution to the public or to any firm or individual, the right to engage in the storage, sale, or other distribution of fuel shall be based upon the following minimum conditions:

  • A. A revocable permit shall be executed and shall provide for the right to store, distribute, sell or otherwise bring onto the airport for use any fuel or lubricant for aviation purposes.

  • B. If the lessee's leased area is inadequate for the installation of fuel storage facilities, the lessee may be allowed to lease, if available and under terms governing such leases, adequate space in a convenient and approved location for construction of facilities for the storage of such fuel.

  • C. The lessee shall provide tank storage facilities, either above or below ground as may be approved by the city to meet the special conditions of the operation and to provide adequate capacity for each grade of fuel stored.

  • D. The lessee shall provide fuel pumping equipment, whether mobile or fixed, meeting all applicable safety requirements including reliable metering devices. All equipment shall be subject to independent inspection, and shall have a pumping efficiency capable of filling the largest aircraft likely to be served by the lessee within reasonable periods of time.

  • E. The lessee shall be required to employ an adequate number of personnel on a full time basis, during such hours as may be, from time to time, established by the city for operation of such facilities, to provide adequate service to the public.

  • F. The lessee shall be required to meet any and all reasonable conditions required by the city in regard to the storage, sale, or other distribution of fuel and lubricants, and any proposal submitted by a prospective lessee, as well as any conditions imposed by the city shall be subject to review and approval by the Federal Aviation Agency. Fees payable to the city for the privilege of storing, selling, or otherwise distributing fuel on the airport shall be at least the same as those established and in force by the city for the lease of the city fuel island facility and shall be in addition to any land or other applicable rental fees.

§ 13.16.180. Lessees required to have office at airport.

Lessees shall be required to maintain an office in a building at the airport in connection with the conduct or operation of their business.

§ 13.16.190. Compliance with "Airport Rules and Regulations" adopted May 1, 1967.

In addition to the standards herein set forth, all persons, firms or corporations using the airport facilities, or any part thereof, shall be required to comply with the mimeographed or printed pamphlet entitled "Airport Rules and Regulations" adopted May 1, 1967 together with any additions or supplements thereto which may be passed by resolution by the city council.
