OFFICES, DEPARTMENTS, COMMITTEES, AND COMMISSIONS

§ 2.04.010. Baseball park committee.

  • A. Committee Created. There is hereby established a baseball park committee to consist of 5 members appointed by the park commission to hold office at the pleasure of the park commission and to perform and discharge the duties as requested by the park commission.

  • B. Credit of City Not to Be Pledged. The baseball park committee shall not have the power to pledge the credit of the city for any expenditures in connection with the use or maintenance of Mitchell Field except to the extent of items contained in an annual budget duly and regularly submitted to and approved by the city council.

§ 2.04.020. Office of assistant chief of police.

  • A. Office Created. A new office in the police department of the city is hereby created. Such office shall be known and designated as "the office of the assistant chief of police." The person holding such office shall be known as the "assistant chief of police." The assistant chief of police shall be appointed by the city council. He or she shall serve at the pleasure of the city council.

  • B. Duties. The assistant chief of police shall discharge all duties which may be assigned to him or her by the chief of police, and shall, during any illness, absence, disability or vacancy in the office of chief of police, discharge all of the duties of the chief of police as prescribed by the Charter of the city, and during such interim or interims shall have all of the rights and powers of such office.

§ 2.04.030. Community development commission.

  • A. Need. It is hereby declared that there is a need for a community development commission to function in the community.

  • B. Established. The community development commission of the city (the commission) is hereby established.

  • C. Purpose. The community development commission is created and established in order that the city will be better able to assist the agency in implementing policy and establishing priorities for redevelopment projects to be undertaken within the city and particularly within the Oroville Redevelopment Project No. 1.

  • D. Powers. The community development commission shall be vested with all of the powers, duties, and responsibilities regarding redevelopment and community development matters which the city council may delegate to said commission subject to such conditions as may be imposed by the city council to cause said commission to function solely in an advisory capacity to the agency as provided in Health and Safety Code Sections 34112 and34141, and nothing herein contained shall affect the existence of the agency as a separate public body, corporate and politic.

  • E. Appointment and Qualifications. The city council shall hereafter by resolution approve

bylaws for the community development commission and annually appoint 7 members, who may subsequently be reappointed for additional one-year terms, who shall serve as commissioners and shall constitute the governing body of the commission, who shall be resident electors of the city other than those serving on the city council or the agency at any given time. Such commissioners may not be an elective officer or an employee of the city, but may be a member, commissioner or employee of any other agency or authority in the city.

  • F. Officers. The community development commission shall elect among its members appointed by the agency a chairperson and a secretary who shall serve in such capacities for a term not to exceed one year.

  • G. Rules, Policies, and Procedures. The community development commission may, pursuant to the bylaws to be adopted for the commission by the city council, adopt such other rules and administrative policies and procedures as deemed appropriate and in furtherance of the purposes for which the commission is hereby established and created.

§ 2.04.040. Offices of city clerk and assessor consolidated.

The offices of city clerk and assessor are hereby united and consolidated and the city clerk shall be ex officio assessor.

§ 2.04.050. Director of finance.

  • A. Office Created. There is created the office of the director of finance who shall be the finance officer of the City of Oroville.

  • B. Powers and Duties. The director of finance shall, under the supervision of the city administrator, assist in the preparation of the city budget and generally administer the fiscal business of the city; supervise the clerical and stenographic personnel in the finance office; and generally perform all duties necessarily incidental to the execution of the fiscal policies of the city as defined by the council.

§ 2.04.060. City surveyor.

  • A. Office Created. There is created the office of city surveyor to be filled by such person or persons as the city council may appoint.

  • B. Powers and Duties. The person or persons appointed as city surveyor shall, under the supervision of city engineer, review for legal compliance and accuracy all parcel maps and subdivision maps, boundary line modifications and mergers, shall prepare check prints, shall sign maps and plats upon completion of review, shall cause parcel maps and subdivision maps to be recorded, and shall perform such other duties as may be required by the city council.

§ 2.04.070. Department of community development and public works.

  • A. Department Created. There is hereby created the department of community development

and public works. The functions of the department shall include:

  1. Administration of public works projects.

  2. Planning, land use and subdivision administration.

  3. Code enforcement.

  4. Engineering and surveying services.

  5. Building permits.

  6. Airport management.

  7. Recycling.

  8. Miscellaneous items associated with reports, grants, plan review, permitting, construction inspection.

  • B.

Director.

  1. The director of community development and public works shall be the department head of the department of community development and public works. The director shall be responsible for the direction and management of all the functions of the department. He or she shall:

    • a. Participate in the preparation of the city capital improvement program and annual budget.

    • b. Plan, organize, direct and coordinate the activities of the department.

  2. The powers and duties of the following offices and positions shall be combined with the office of the director of community development and public works:

    • a. Superintendent of public streets.

    • b. Director of public works.

    • c. City surveyor or designee.

    • d. City engineer or designee.

  3. The director is appointed to the above designated offices and positions for all purposes under the City Charter and other city ordinances, resolutions and policies.

  • C. Appointment—Term of office—Qualifications.

    1. The director shall be appointed by the city council in accordance with provisions set forth in Article VI of the City Charter. He or she shall hold office at the pleasure of the council. He or she shall be appointed wholly on the basis of his or her administration and executive ability and qualifications.

    2. The director shall receive such compensation and benefits as the council shall from time to time determine and such compensation and benefits shall be a charge against such funds of the city as the council shall designate.

§ 2.04.080. Department of business assistance and housing development.

  • A. Department Created. There is hereby created the department of business assistance and housing development. The function of the department shall include managing:

    1. Redevelopment agency housing set-aside program administration.

    2. Community development block grant program administration.

    3. Home investment partnerships grant program administration.

    4. Rural business enterprise grant program administration.

    5. Rural business opportunity grant program administration.

    6. Revolving loan funds program administration.

    7. Small business loan program.

    8. Owner occupant housing rehabilitation programs.

    9. First time home buyer mortgage subsidy loan programs.

    10. First time home buyer projects.

    11. In fill first time home buyer construction program.

    12. Public service and/or community facility programs and projects.

    13. Business technical assistance program.

    14. Micro-enterprise business technical assistance program.

    15. Planning technical assistance grant activities.

    16. Multifamily rehabilitation program.

    17. Multifamily acquisition, new construction, and rehabilitation projects.

    18. Recycling market development zone.

    19. Redevelopment agency business loan program.

    20. Enterprise zone.

  • B. Director. The director of business assistance and housing development shall be the department head of the department of business assistance and housing development. The director shall be responsible for the direction and management of all the functions of the department. He or she shall:

    1. Participate in the preparation of the annual budget relating to the functions of the department.

    2. Plan, organize, direct and coordinate the activities of the department.

  • C. Appointment—Term of office—Qualifications.

  1. The director shall be appointed and removed by the city council in accordance with provisions set forth in Article VI of the City Charter. He or she shall hold office at the pleasure of the council. He or she shall be appointed wholly on the basis of his or her administration and executive ability and qualifications.

  2. The director shall receive such compensation and benefits as the council shall from time to time determine and such compensation and benefits shall be a charge against such funds of the city as the council shall designate.

§ 2.04.090. Improvement Act of 1911.

  • A. Adopted. The provision referred to as the "Improvement Act of 1911" is hereby adopted by the city, subject to the provisions set forth in the following subsections.

  • B. Authority Granted City Council. The city council shall have the power when it elects so to do, to order any improvement or work mentioned in Section 2 and part of Section 1 of the Improvement Act of 1911 without awarding a contract therefor, and to purchase the materials, hire the labor and do all things necessary for the doing of the work and improvement subject to the terms of the ordinances and the Charter of the city, and to pay the costs and expenses of such improvement work out of the fund created for the accomplishment of the work according to the provisions of the aforementioned act.

  • C. Procedure Where Bonds Not Issued. In cases where bonds are not ordered to be issued for improvement work done pursuant to the 2 preceding sections, it shall be the duty of the city engineer to certify to the city tax collector a list of the properties within the city upon which liens exist for assessments for such work, and the city tax collector shall insert in the tax rolls as to each such parcel of property, such assessment and the amount thereof. When so entered, such assessment shall be a lien upon the property and shall be paid at the same time and in the same manner as the property tax assessed for that year. In the event of delinquency in the payment of the assessment, penalties and interest shall be added in the same manner as with the taxes, and the property shall be sold to satisfy assessments in the same manner as is provided for the sale of property for delinquent taxes.

  • D. City Engineer to Perform Duties, etc., of Street Superintendent. Whenever in the Improvement Act of 1911, adopted by the 3 preceding sections, reference is made to the street superintendent or powers or duties are conferred upon the street superintendent, the words "street superintendent" shall be read as "city engineer" and the city engineer shall perform the powers and duties prescribed by such act for the street superintendent.

§ 2.04.100. Law enforcement officer training program.

  • A. Qualification for State Aid. The city hereby declares that it desires to qualify to receive aid from the state under the provisions of Chapter 1 of Title 4, Part 4 of the State Penal Code.

  • B. Standards. Pursuant to Section 13522 of the State Penal Code, the city while receiving aid from the state pursuant to Chapter 1 of Title 4 of such Code will adhere to the standards for recruitment and training established by the State Commission on Peace Officer Standards and Training.

§ 2.04.110. Criminal conduct—Ineligibility for employment.

  • A. No person convicted (including pleas of guilty and nolo contendere) of a felony or a misdemeanor or involving moral turpitude shall be eligible for employment by any department of the city; provided, however, that the appointing authority may disregard such conviction if it is found and determined by such appointing authority that mitigating circumstances exist, such as, but not limited to, evidence of rehabilitation, length of time elapsed since such conviction, the age of such person at the time of conviction, or the fact that classification applied for is unrelated to such conviction.

  • B. The city administrator, chief of police, city attorney, deputy city attorney, and each appointing authority of the city are hereby authorized to have access to "state summary criminal history information" as provided for in Section 11105 of the Penal Code of the State of California when it is required to assist such individual in fulfilling employment responsibilities set forth in this section.
