§ 12.32.010. Purpose.

This chapter is adopted pursuant to the municipal affairs provisions of the City Charter for the purpose of regulating parades, athletic events and public assemblies occurring on or within a city street, sidewalk or other public right-of-way which obstruct, delay or otherwise interfere with the normal flow of vehicular or pedestrian traffic, and/or which do not comply with applicable traffic laws or controls.

§ 12.32.020. Definitions.

Unless the contrary is stated or clearly appears from the context, the following definitions shall govern the construction of the words and phrases used in this chapter:

"Aggrieved person" shall mean any person who is adversely affected by a determination made or taken by a city officer or employee pursuant to the provisions of this chapter in a manner significantly greater than the public generally, including, but not limited to, any applicant for a permit required by this chapter who is adversely affected by the action of the director of community development on such permit.

"Athletic event" shall mean any event in which a group of persons collectively engage in a sport or form of physical exercise on or within a city street, sidewalk or other public right-of-way, including, but not limited to, jogging, running, racing, bicycling and roller skating.

"Director" shall mean the director of community development.

"Event" shall mean any parade, athletic event or public assembly.

"Parade" shall mean any march or procession of persons, animals and/or vehicles on or within a city street, sidewalk or other public right-of-way.

"Public assembly" shall mean any group of people participating in an organized activity on or within a city street, sidewalk or other public right-of-way, other than a group of people participating in a parade or athletic event.

§ 12.32.030. Administration by director of community development.

The director of community development shall have primary responsibility for the administration of the provisions of this chapter, subject to the overall direction and control of the city administrator. In carrying out such responsibilities, the duties of the director shall include, but not be limited to, acting on all applications for a permit required by this chapter. The director shall be assisted in administering the provisions of this chapter by the chief of police and fire chief who shall be responsible for reviewing and making recommendations to the director on all applications for a permit required by this chapter. In addition the chief of police and fire chief, together with the director, shall be authorized to revoke a permit issued pursuant to this chapter in the manner provided for herein.

§ 12.32.040. Administrative review of determination or action of director of community…

  • A. Right to Administrative Review. Any person aggrieved by a determination made or action taken by the director, chief of police or fire chief pursuant to the provisions of this chapter may apply to the city administrator for administrative review of a determination made or action taken.

  • B. Applications for Administrative Review. Applications for administrative review of a determination made or action taken by the director, chief of police or fire chief pursuant to the provisions of this chapter shall be filed in the office of the city administrator not later than 5 days following the date such determination was made or such action was taken, or where the director, chief of police or fire chief are required to serve a notice of the determination or action, 5 days following the date such notice is served, provided that the city administrator may extend the time for filing such application for good cause shown. Such application shall be in a form prescribed by the city administrator, shall contain a brief statement of the reasons why the person applying for administrative review believes such determination or action does not comply with the provisions of this chapter and shall set forth the relief requested by such person from such determination or action.

  • C. Decision on Application for Administrative Review. Within 10 days following the filing of an application for administrative review of a determination made or action taken by the director, chief of police or fire chief pursuant to the provisions of this chapter, the city administrator shall consider the application and render a decision either affirming such determination or action or reversing or modifying the determination or action. Prior to rendering a decision, the city administrator may, at the city administrator's discretion, convene an informal meeting for the purpose of receiving evidence or hearing arguments bearing on such decision, provided notice of the date, time and place of such hearing is served on the person who filed the application for administrative review within a reasonable time prior to such hearing. After rendering a decision, the city administrator shall promptly inform the director, chief of police or fire chief of the decision, and cause notice of the decision to be served on the person who filed the application for administrative review.

§ 12.32.050. Appeal from decision of city administrator to city council.

  • A. Right of Appeal. Any person aggrieved by a decision of the city administrator following the filing of an application for administrative review of a determination made or action taken by the director of community development, chief of police or fire chief pursuant to the provisions of this chapter may appeal such decision of the city administrator to the city council.

  • B. Notice of Appeal. Appeals from the decision of the city administrator following the filing of an application for administrative review of a determination made or action taken by the director of community development, chief of police or fire chief pursuant to the provisions of this chapter shall be made by filing a notice of appeal with the city clerk not later than 5 days following the date the city administrator serves a notice of such decision, provided that the city council may extend the time for filing such notice of appeal for good cause shown. Such notice of appeal shall be in a form prescribed by the city administrator, shall contain a brief statement of the reasons why the person filing the appeal believes that the

decision of the city administrator does not comply with the provisions of this chapter and shall set forth the relief requested by such person from such decision.

  • C. Appeal Procedures. Appeals from a decision of the city administrator following filing of an application for the administrative review of a determination made or action taken by the director of community development, chief of police or fire chief pursuant to the provisions of this chapter shall be heard and decided by the city council at its first regular or adjourned regular meeting on or after the tenth day following the filing of an appeal.

§ 12.32.060. Designated parade routes.

In order to implement the provisions of this chapter, the city council by resolution(s) adopted from time to time following the effective date of this chapter, shall establish designated parade routes within the city, as well as the traffic control fees to be charged to those persons applying for a permit to conduct a parade or athletic event along such designated parade route in the manner hereinafter provided by this chapter.

§ 12.32.070. Permit requirements.

It is unlawful for any person to conduct, sponsor or knowingly participate in any parade, athletic event or public assembly on or within any city street, sidewalk or other public right-of-way which obstructs or interferes with the normal flow of vehicular or pedestrian traffic and/or which does not comply with applicable traffic laws or controls unless and until a permit for such event has been approved and issued in a manner hereinafter provided by this chapter, except that such permit shall not be required for a parade consisting of a vehicular funeral procession or wedding procession.

§ 12.32.080. Application for permit.

  • A. Place and Time of Filing.

    1. Applications for a permit authorizing a parade, athletic event or public assembly shall be filed in the office of the director at least 25 days prior to the date of such event in order to ensure adequate time for administrative review by the city administrator of a determination by the director of community development to deny the application or approve the application subject to conditions, and at least 70 days prior to the date of such event in order to ensure adequate time for administrative review by the city administrator of a determination of the director to deny the application or approve the application subject to conditions, as well as an appeal to the city council of a decision by the city administrator on such determination following administrative review of same.

    2. Nevertheless, applications for a permit authorizing a parade or athletic event along a designated parade route shall be acted upon by the director of community development if filed in the office of the director at least 7 days prior to the date of such parade or athletic event, and applications for a permit authorizing any other event shall be acted upon by the director if filed in the office of the director at least 10 days prior to the date of such event. Moreover, the time for filing an application

for a permit authorizing any event may be waived by the director if the director determines that sufficient time remains to review, investigate and act on the application in the manner hereinafter required by this chapter prior to the date of the event. However, where an application for a permit authorizing an event is not filed at least 25 days prior to the date of such event, any right to administrative review by the city administrator of a determination of the director to deny the application or approve the application subject to conditions shall be deemed waived if there is insufficient time for such administrative review, and where an application for a permit authorizing an event is not filed at least 70 days prior to the date of such event, any right to both the administrative review by the city administrator of a determination of the director to deny the application or approve the application subject to conditions and an appeal to the city council of the decision of the city administrator on such determination following administrative review of same shall be deemed waived if there is insufficient time for such administrative review and appeal.

  • B. Form and Content. Applications for a permit authorizing a parade, athletic event or other public assembly shall be filed by a natural person, shall be in a form prescribed by the director of community development, and shall contain all of the following information:

    1. Information Required for All Events. Applications for all events shall contain:

      • a. The name, home and business address, and home and business telephone number of the person filing the application;
  • b. If the event is to be conducted by an organization, the name, address and telephone number of the organization, the name, home and business address and the home and business telephone number of the president, leader or other head of the organization, and documentation of the authority under which the applicant is applying the permit on behalf of the organization;

    • c. The name, home and business address, and home and business telephone number of the person who will be present and in charge of the event on the date of the event;

    • d. The name, home and business address, and home and business telephone number of any monitors to be employed during the event;

    • e. The nature of the event;

    • f. The proposed date and estimated starting and ending time of the event;

    • g. The proposed location of the event, including its boundaries;

    • h. The estimated number of participants in the event;

    • i. The type and estimated number of vehicles, animals and structures which will be used in the event;

    • j. A description of any sound amplification equipment to be employed at the event;

    • k. The parking requirements for the event;

    • l. The location of any water and/or first aid stations to be provided at the event;

and

  • m. The type and number of any vendors who will sell food or beverages at the event pursuant to a hawking or peddling permit issued in the manner provided for by Title 5 of this Code.
  1. Additional Information Required for Parades. In addition to the information required by subsection A of this section, every application for a parade shall include the following information:

    • a. The time when units of the parade will begin to assemble;

    • b. The proposed assembly point for the parade;

    • c. The proposed parade route;

    • d. The interval space to be maintained between units of the parade;

    • e. The number, type and size of floats; and

    • f. The composition and maximum size of any signs or banners to be carried along the parade route.

  2. Supplemental Information Required by Director of Community Development. In addition to the information required by paragraphs 1 and 2 of this subsection, applications for all permits authorizing an event shall include such supplemental information which the director shall find reasonably necessary, given the nature of the event, in order to determine whether to approve or disapprove a permit authorizing such event in the manner hereinafter provided by this chapter.

  • C. Application Fee—Waiver.

    1. Every application for a permit authorizing a parade, athletic event or public assembly shall be accompanied by an application fee in an amount established by resolution of the city council.

    2. The city administrator or his/her designee is authorized to waive the application fee required by this section for any permit authorizing a parade or public assembly where:

  • a. The parade or public assembly involves an exercise of free speech rights;

    • b. The parade or public assembly is sponsored by a non-profit organization; or

    • c. The parade or public assembly is sponsored by the City of Oroville.

  • D. Review by Chief of Police and Fire Chief. Upon the filing of an application for a permit authorizing a parade, athletic event or public assembly, the director of community development shall immediately forward the application to the chief of police and fire chief for their review and recommendations. Following receipt of such application, the chief of police and fire chief shall consider the application and report back to the director their recommendations on the action to be taken by the director on the application, including, but not limited to, their recommendations in regard to the special conditions of any permit issued pursuant to such application, all prior to the date the director is required to act on the application. In the report of the chief of police on an application for a permit authorizing an

event other than a parade or athletic event conducted along a designated parade route, the chief shall set forth the number, type and estimated hours of employment of all police department personnel which will be necessary to control traffic during the event or otherwise monitor the event in order to enable the director to compute a traffic control fee for the event.

§ 12.32.090. Action on permit application.

  • A. Time for Taking Action. Following the filing of a completed application for a permit authorizing a parade, athletic event or public assembly, the director of community development shall act on the application, either by approving or disapproving the application, not later than 7 days from the date of filing the application where the application is for a permit authorizing a parade or athletic event which will be conducted along a designated parade route; not later than 15 days from the date of filing the application where the application is for an event which will not be conducted along a designated parade route; and as soon as practicable prior to the date of an event where the director has waived the time for filing of an application for the event in the manner hereinbefore provided in this chapter.

  • B. Approval and Issuance of Permit. Where the director of community development determines that a completed application has been filed for a permit authorizing a parade, athletic event or public assembly in a manner required by this chapter, that there is no reason for proposing approval of a permit authorizing the event on alternative dates or times and/or at alternative locations, and that there are no grounds for denying such permit, the director shall approve such permit subject to all the general conditions herein-after required by this chapter plus any special conditions authorized by this chapter and determined by the director to be necessary in order to protect the safety of persons and property and/or the control of pedestrian and vehicular traffic in and around the site of the event. Upon approving an application for a permit authorizing an event, the director shall promptly cause a notice of such action to be served on the permit applicant and shall also provide copies of such notice to the city administrator, chief of police and fire chief. Thereafter, the director shall issue a permit authorizing the event to the person or organization designated as the permittee on the application when the permittee has executed the indemnification agreement, provided the liability insurance and paid the traffic control fee required as a general condition for such permit, and has complied with all special conditions of the permit which are required as conditions precedent to the issuance of the permit.

  • C. Permit Alternatives. Where the director of community development determines that a completed application has been filed for a permit authorizing a parade, athletic event or public assembly which threatens to substantially endanger public safety, but that such endangerment could be eliminated or significantly reduced by changing the date, time and/ or location of such event in a manner which does not unreasonably interfere with the exercise of free speech rights, or where the director determines that there are grounds for denying such application but that such grounds would not exist if there was a change in the date, time and/or location of the event, the director shall propose approval of a permit authorizing the event on such alternative dates or times and/or locations. Promptly following such action, the director shall cause a notice proposing such permit alternatives to be served on the permit applicant and shall also provide copies of such notice to the city

administrator, the chief of police and fire chief. In such notice, the director shall set forth, with particularity, the reasons for the determination of the director not to approve the event proposed by the application on the date or time or at the location set forth therein. Any applicant desiring to accept such permit alternatives shall file a written notice of acceptance with the director not later than 5 days after service of such notice of permit alternatives. In the event the applicant fails to accept such permit alternatives in a manner and within the time provided for herein, then the permit application shall be deemed denied.

  • D. Denial of Permit.

    1. Grounds for Denial. The director of community development shall deny any permit required by this chapter if the director determines that:

      • a. The person applying for the application has failed to provide the supplemental information requested by the director, or has otherwise failed to complete the application;

      • b. The information contained in the application, including supplemental application information requested by the director, is found to be false in any material respect;

      • c. An application for another event to be held on the same date as that requested by the applicant has been previously filed or approved, and such other event is so close in time and location to the event proposed by the applicant as to cause undue traffic congestion or to place the city in a position of being unable to meet the needs for police services for both events;

  • d. The time, route or size of the event will substantially interrupt the safe and orderly movement of traffic contiguous to the site or route of the event or disrupt the use of a street at a time when it is usually subject to great traffic congestion;

    • e. The concentration of persons, animals and/or vehicles at the site of the event or at the site of an assembly or disbanding area around the event will prevent proper police, fire or ambulance services to areas contiguous to the event;

    • f. The size of the event will require the diversion of so great a number of city police officers to ensure that participants stay within the boundaries or route of the event, or to protect participants in the event, as to cause police protection to the rest of the city to be seriously jeopardized; provided, however, that nothing herein authorizes the denial of a permit because of the need to protect participants from the conduct of others if reasonable permit conditions can be imposed to allow for adequate protection of event participants given the number of city police officers available to monitor the event;

    • g. The event consists of a parade or athletic event moving along a route which will not move from its point of origin to its point of termination in 3 hours or less;

    • h. The location of the event will substantially interfere with construction or maintenance work previously scheduled to take place on or along the city street, sidewalk or other public right-of-way to be occupied by the event;

    • i. The event will occur at a time when a school is in session and along a route or at a location adjacent to the school or a class thereof, and the noise created by

the activities of the event will substantially disrupt the educational activity of such school or class.

  1. Notice of Denial. Where the director of community development determines to deny an application for a permit authorizing a parade, athletic event or public assembly, the director shall promptly cause a notice of such determination to be served on the permit applicant and shall provide copies of such notice to the city administrator, city attorney, chief of police and fire chief. In such notice the director shall set forth, with particularity, the reasons for the determination of the director not to approve the event proposed by the application.

§ 12.32.100. General permit conditions.

  • A. Indemnification Agreement. As a condition precedent to the issuance of a permit authorizing a parade, athletic event or public assembly, the permittee shall enter into an agreement with the city in a form approved by the city attorney which shall set forth the undertaking of the permittee to indemnify the city, hold the city harmless and reimburse the city from and for any liability, damage or loss caused by the negligent or intentional act or omission of the permittee, any officer, employee or agent of the permittee, or any person who is under permittee's legal control. In addition, such agreement shall provide that in the event a claim is made against the city by suit or otherwise, whether the same is groundless or not, arising out of such negligent or intentional act or omission, then the permittee shall defend the city and shall indemnify the city for any judgment rendered against it or any sums paid out in settlement or otherwise. Such agreement shall be filed with the director of community development prior to the issuance of the permit.

  • B. Liability Insurance.

    1. Insurance Requirements. As a condition precedent to the issuance of a permit authorizing a parade, athletic event or public assembly, the permittee shall obtain public liability insurance from an insurance company licensed to do business in the State of California, having a financial rating in Best's Insurance Guide of at least "B," and which provides insurance coverage against liabilities, death, personal injury or property damage arising out of or in any way connected with such event. Such insurance shall be in a form approved by the city's finance director, shall be filed with the director of community development prior to the issuance of the permit, and such insurance shall be maintained in full force and effect throughout the course of the event authorized by the permit.

    2. The insurance required by this section shall be waived by the director where the parade, athletic event or public assembly is sponsored by the City of Oroville.

  • C. Traffic Control Fee.

    1. Fee Requirements. As a condition precedent to the issuance of a permit authorizing a parade, athletic event or public assembly, the permittee shall pay to the city a fee in an amount equal to the city's total estimated costs for providing all of the personnel and materials, including, but not limited to, police department personnel, which are necessary in order to control and monitor pedestrian and vehicular traffic in and around the site of such event. Such traffic control fee shall be determined by the

director of community development based upon a schedule of traffic control fees and rates established by resolution of the city council; the estimate of the chief of police of the type, number, and hours of employment of police department personnel necessary to control and monitor pedestrian and vehicular traffic in and around the site of the event, all as set forth by the chief of police in the chief's report on the event; and on the estimate of the director as to the type, number and hours of employment of other city personnel necessary to control or monitor the event. Such fee shall be paid by the permittee prior to the issuance of the permit.

  1. Waiver of Traffic Control Fee. The city administrator is authorized to waive the traffic control fee required by this section for any permit authorizing a parade or public assembly where:

    • a. The parade or public assembly involves an exercise of free speech rights;

    • b. The parade or public assembly is sponsored by a non-profit organization; or

  • c. The parade or public assembly is sponsored by the City of Oroville.

§ 12.32.110. Special permit conditions.

When acting on a permit authorizing a parade, athletic event or public assembly, the director of community development may condition such permit or the issuance thereof upon the permittee's compliance with reasonable requirements concerning the time, place and/or manner of conducting such event which are necessary to protect the safety of persons and property, and/or to control vehicular and pedestrian traffic in and around the site of the event, provided that such requirements shall not unreasonably restrict the exercise of free speech rights. Such conditions may include, but shall not be limited to, requirements concerning the following:

  • A. The assembly or disbanding area for a parade or athletic event occurring along a route;

  • B. The accommodation of pedestrian and vehicular traffic in and around the site of an event, including restricting an event to a city sidewalk, or only a portion of a city street or other public right-of-way;

  • C. The number and type of vehicles, animals and/or structures to be displayed or used in the event;

  • D. The inspection and approval by city personnel of stages, booths, floats and other structures or vehicles to be used or operated in the event, in order to ensure that such structures or vehicles have been safely constructed and/or can be safely operated;

  • E. The deposit of a sum of money as and for a clean-up deposit where the event will include the erection of structures, the display or use of horses or other large animals, the operation of water aid stations or the sale of food or beverages pursuant to a hawking or peddling permit issued in a manner provided by Title 5 of this Code;

  • F. The provision and use of traffic cones and barricades;

  • G. The provision and operation of first aid stations and/or sanitary facilities, including handicap-accessible sanitary facilities;

  • H. The provision and use of garbage containers and the clean up and restoration of the site of the event at the termination of the event;

  • I. The use of sound amplification equipment and the amount of noise generated by motors and other equipment used in the course of the event; and

  • J. The provision of a notice of permit conditions to event participants. (Ord. 1533 § 3)

§ 12.32.120. Revocation of permit.

  • A. Revocation by Director of Community Development. The director shall revoke a permit authorizing a parade, athletic event or public assembly where the director determines that there were grounds for denying the permit in the manner hereinbefore provided for by this chapter which were first disclosed or otherwise made known to the director after issuance of the permit.

  • B. Revocation by Director of Community Development, Police Chief or Fire Chief. The director, chief of police or fire chief may revoke a permit authorizing a parade, athletic event or public assembly where the director, chief of police or fire chief determines that the event is being conducted in violation of the terms and conditions of the permit, or where the event participants have violated or threatened to violate any applicable law or regulation; provided, however, that this subsection shall not authorize the revocation of a permit because of the need to protect participants from the conduct of others; and, provided further, that the director, chief of police or fire chief shall not revoke a permit in the manner provided by this subsection unless and until such city officer advises the permittee and/or responsible event participants of such violation and provides the permittee with a reasonable opportunity to correct same.

  • C. Notice of Revocation. Where the director of community development, chief of police or fire chief determines to revoke a permit authorizing a parade, athletic event or public assembly prior to the date of such event, such city officer shall promptly cause a notice of such action to be served on the permittee and shall provide copies of the notice to the city administrator, city attorney and all remaining city officers charged with carrying out any responsibilities under this chapter. However, where the director, chief of police or fire chief determines to revoke a permit authorizing a parade, athletic event or public assembly on the day of such event, such city officer shall announce such action to the event participants, to those city officers and employees engaged in monitoring or controlling traffic during the event and to the person in charge of the event where such person can be located at the site of the event. Thereafter, the city officer revoking such permit shall cause a written notice of such action to be served on the permittee, and shall provide copies of such notice to the city administrator and the city attorney. In such written notice, the city officer revoking the permit shall set forth, with particularity, the reasons for such action.

§ 12.32.130. Emergency suspension of authorized event.

The director of community development, chief of police, fire chief and any sworn peace officer employed by the city may temporarily suspend a parade, athletic event or public assembly authorized by a permit issued in a manner hereinbefore provided by this chapter whenever there is a fire or other emergency which requires the event to be temporarily suspended to protect

public safety. When an event is temporarily suspended for this reason, the permittee and event participants shall immediately comply with the suspending officer's instructions. (Ord. 1533 § 3)

§ 12.32.140. Cordoning off the route or site of an event.

The director of community development is authorized and directed to place barricades on or within the city's streets, sidewalks or other public rights of way and/or to undertake such other actions as may be necessary to cordon off the route or site of a parade, athletic event or public assembly authorized by a permit issued in the manner provided for by this chapter. In addition, the director, when appropriate, shall post the route or site of such event as a no parking zone for the duration of the event and sufficiently in advance thereof as may be necessary to preclude vehicles parking along the route or at the site of the event. § 12.32.150. Notice to adjoining property owners.

The director of community development shall endeavor to give notice of the nature, date and time of any parade, athletic event or public assembly authorized by a permit issued in the manner hereinbefore provided in this chapter as soon as possible prior to the date of such event to all owners of property adjoining the city street, sidewalk or public right-of-way where such event is to occur, either by serving copies of such notice on such property owners, by publishing such notice in a newspaper of general circulation or by posting such notice along the route or at the site of the event. However, the provisions of this section pertaining to such notice shall be directory only, and failure of the director to give such notice shall not invalidate a permit. (Ord. 1533 § 3)

§ 12.32.160. Interference with event—Driving through site—Prohibited parking.

  • A. Interference with Parade, Athletic Event and Public Assembly. No person shall obstruct, impede, hamper or otherwise interfere with any parade, athletic event or public assembly authorized by a permit issued in the manner hereinbefore provided in this chapter, nor with any person, animal or vehicle participating or used in such event.

  • B. Driving Through the Site of Parade or Athletic Event. No person shall drive a vehicle between vehicles or persons transversing the route of a parade or athletic event authorized by a permit issued in the manner hereinbefore provided by this chapter when such vehicles or persons transversing the route of such parade or athletic event are in motion.

  • C. Prohibited Parking. No person shall park along or within any portion of the route or site of a parade, athletic event or public assembly authorized by a permit issued in the manner hereinbefore provided by this chapter which has been posted as a no parking zone by the director of community development in the manner authorized by this chapter.

§ 12.32.170. Congestion on sidewalk.

Except when authorized by a permit authorized pursuant to this chapter of the Code, it shall be unlawful for any person to obstruct the free passage of traffic upon any sidewalk. Authority is hereby given to the chief of police and the chief's assistants, when there is any gathering or crowd upon the sidewalk which is obstructing the free and uninterrupted passage of pedestrians thereon,

to direct such traffic, which authority shall exist during the entire time of such congestion. Where crowds gather on the sidewalk in front of a theater or any other public place, the city administrator is given authority to designate where such crowd shall stand and may give notice thereof by causing the erection of markers or other signs, and it shall be unlawful for any person in such crowd to disobey such markers and signs and also to disobey the directions given by the chief of police and the chief's assistants.

§ 12.32.180. Violations.

Any violation of the provisions of this chapter, including any violation of the terms and conditions of a permit approved and issued in the manner provided in this chapter, shall be an infraction which is punishable by a fine in the amount provided for by Title 1 of this Code. (Ord. 1533 § 3)
