2.08.010 - Appointment.

A. The office of the city manager is established. The city manager shall be appointed by the city council solely on the basis of his executive and administrative qualifications and shall hold office during the pleasure of the city council.

B. During the absence or disability of the city manager, the city council may designate some properly qualified person to perform the duties of the office of city manager.

2.08.020 - Bond.

The city manager shall furnish a surety company bond to be approved by the city council in such sum as may be determined by the city council.

2.08.030 - Powers and duties designated—Limitations.

A. The city manager shall be the administrative head of the city government under the direction and control of the city council. He shall be responsible to the city council for the efficient administration of all the affairs of the city which are under his control. In addition to his general powers as administrative head, and not as a limitation thereon, it shall be the duty of the city manager, and he shall have power:

  1. To see that all laws and ordinances are duty enforced;

  2. To appoint, discipline and dismiss the chief of police, all heads of departments, and all subordinate officers and employees of the city, except the city clerk, the city attorney and the city treasurer; to transfer employees from one department to another; and to consolidate or combine offices, positions, departments or units under his jurisdiction;

  3. To exercise control over all departments and divisions of the city government and over all appointive officers and employees thereof, except the city attorney;

  4. To attend all meetings of the council and its committees unless excused therefrom by the city council, except when his removal is under consideration by the city council;

  5. To recommend to the council for adoption such measures and ordinances as he deems necessary or expedient;

  6. To keep the city council at all times fully advised as to the financial condition and need of the city;

  7. To prepare and submit to the city council the annual budget;

  8. To prepare and recommend to the city council a salary plan;

  9. To purchase all supplies for all of the departments or divisions of the city. No expenditure shall be submitted or recommended to the city council, except upon report or approval of the city manager;

  10. To make investigations into the affairs of the city, and any department or division thereof, and any contract, or the proper performance of any obligation running to the city;

  11. To investigate all complaints in relation to matters concerning the administration of the government of the city and in regard to the service maintained by public utilities in the city, and to see that all franchises, permits and privileges granted by the city are faithfully observed;

  12. To exercise general supervision over all public buildings, public parks, streets and other public property which are under the control and jurisdiction of the city council;

  13. To devote his entire time to the duties and interests of the city;

  14. To prepare and submit to the city council an organization chart showing the current organization plan for all departments of the city government;

  15. To issue on behalf of the council all licenses and permits not otherwise provided for by ordinance;

  16. To superintend the construction of all public works within the city;

  17. To prepare and submit to the council as of the end of the fiscal year a complete report on the finances and administrative activities of the city for the preceding year;

  18. To make, compile and file with the city clerk a complete inventory of the property, real and personal, owned by the city and file amended inventories thereof at least semiannually as to stock, supplies and equipment, and at least annually as to other properties;

  19. To serve in any appointed office or head of department within the city government to which he may be qualified, when appointed thereto by the city council, and to hold and perform the duties thereof at the pleasure of the city council;

  20. To perform such other duties and exercise such other powers as may be delegated to him from time to time by ordinance or resolution of the city council;

  21. To establish rules and regulations by and with the consent of the city council that may be found from time to time to be necessary in the efficient discharge of the duties of the city manager.

B. The city manager, among other limitations, shall have no power to:

  1. Levy any tax, assessment or charge on any real or personal property or against any person or persons, or firm or corporation;

  2. Exercise any legislative function;

  3. Expend any sum of money, except in accordance with the approved budget or with prior approval of the city council;

  4. Create or abolish any municipal office, except with the approval of the city council;

  5. Increase or decrease the salary or emoluments of any city employee, except with the approval of the council;

  6. Sell, lease or encumber any real estate belonging to the city;

  7. Grant, cancel or revoke any franchise;

provided, however, that nothing in this subsection shall be construed to prevent the city manager from making recommendations in the proper case, and nothing in this subsection shall be construed to prevent the city council from ratifying any lawful act of the city manager.

2.08.040 - Ex officio membership on boards and commissions.

The city manager shall be an ex officio member of the board of library trustees and all other boards and commissions appointed by the mayor or city council pursuant to law, with a right to participate in all deliberations or actions by his voice, but without vote.

2.08.050 - Limitations on political activity.

The city manager is forbidden to take part in any political campaign, or to take any part in securing contributions for any political campaign or candidate. This section pertains only to municipal elections.

2.08.060 - Compensation.

The city manager shall receive such compensation as the city council shall from time to time determine, but such shall not be less than three hundred fifty dollars per month, and shall be in full for all services rendered. He shall also be reimbursed for and shall be allowed traveling expenses when absent from the city on business pertaining to his city office or to the business of the city, together with all sums necessarily incurred or paid by him while absent on authorized city business; but no such reimbursement or allowance shall be made excepting upon an itemized claim presented for approval to the city council and by it approved and allowed.

2.08.070 - Administrative cooperation.

Except for the purpose of inquiry, the city council and its members shall deal with the administrative service solely through the city manager, and neither the city council nor any member thereof shall give orders to any of the subordinates of the city manager.
