9.20.010 - Title.

This chapter shall be known as the "City Sewer System Regulations" and may be cited as such.

9.20.020 - Scope.

A. The provisions of this chapter shall apply to the design, construction, alteration, use and maintenance of the City sewer system, including, but not limited to, main line sewers, building sewers, building laterals, wastewater pretreatment systems, regional wastewater treatment plants, gravity separation interceptors, and other appurtenances; the issuance of permits and the collection of fees therefor, to cover the costs of checking plans, inspecting construction, and making record plans of the facilities permitted; and provision for penalties for the violation of any of the provisions of this chapter.

B. Design and construction of the City sewer system shall be pursuant to the document entitled "Specifications for the Design and Construction of Public Works Facilities for the City of Montclair" as adopted by the Montclair City Council.

C. The purpose of this chapter is to provide for the maximum beneficial use of the City sewer system, groundwater resources and effluent-receiving waterways through regulation of wastewater discharges by establishing terms, limits and conditions of discharge through the enforcement of general requirements for domestic wastewater users and the issuance of industrial user discharge permits; to provide for equitable distribution of the City's costs; and to provide procedures for complying with requirements placed upon the City by State and federal regulations. This is accomplished in compliance with the NPDES permits issued by the California Regional Water Quality Control Board in conformity with 40 CFR, Part 403, the Clean Water Act as amended by the Water Quality Act of 1987, and the California Water Code as amended.

D. The objectives of this chapter are:

  1. To prevent the introduction of pollutants into the City sewer system which would interfere with operation of the regional system or contaminate the resulting sludge;

  2. To prevent the introduction of pollutants into the City sewer system which would pass inadequately treated through the regional system into receiving waters or into the atmosphere or otherwise be incompatible with the regional system;

  3. To improve the opportunity to recycle and reclaim wastewater and sludge from the system;

  4. To provide for regulation of direct and indirect contributors to the City sewer system through the issuance of industrial user discharge permits to certain nondomestic users and through the enforcement of general requirements for other users, to authorize monitoring and enforcement activities, to require user reporting, to provide that existing customers' capacity will not be preempted, and to provide for the setting of fees for the equitable distribution of costs resulting from the program established in this chapter.

E. Any fines imposed by a regulatory agency other than the City as a result of a violation of the provisions of this chapter shall be in addition to any charges or fees imposed by the City.
