3.36.010 - Purpose.

Pursuant to Resolution 99-67 of the Mono County board of supervisors, Mono County has elected to become subject to the uniform construction cost accounting procedures set forth in the Uniform Public Construction Cost Accounting Act (Section 22000 et seq. of the California Public Contract Code). The Act requires each public agency that elects to become subject to the Act to enact an informal bidding ordinance to govern the selection of contractors pursuant to subdivision (b) of Section 22032 of the Public Contract Code. This chapter is intended to satisfy that requirement.

3.36.020 - Informal bidding procedures.

The procedures specified by this chapter shall apply only to public projects let to contract by informal procedures in accordance with Section 22032, subdivision (b), of the California Public Contract Code (as the same may be amended from time to time). They shall be followed in addition to any other procedures that may be specified by the Uniform Public Construction Cost Accounting Act (Section 22000 et seq. of the California Public Contract Code) or by policies, manuals, or other regulations of the California Uniform Public Construction Cost Accounting Commission.

3.36.030 - Contractor's list.

A list of contractors shall be developed and maintained by the Mono County public works department in accordance with the provisions of Section 22034 of the Public Contract Code and criteria promulgated from time to time by the California Uniform Construction Cost Accounting Commission.

3.36.040 - Notice inviting informal bids.

A. Where a public project is to be performed which is subject to the provisions of this chapter, a notice inviting informal bids shall be mailed to all contractors for that category of work to be bid, as shown on the list developed in accordance with Section 3.36.020, and to all construction trade journals as specified by the California Uniform Construction Cost Accounting Commission in accordance with Section 22036 of the Public Contract Code. Additional contractors and/or construction trade journals may be notified at the discretion of the department/agency soliciting bids; provided however:

  1. If there is no list of qualified contractors maintained by the county for the particular category of work to be performed, the notice inviting bids shall be sent only to the construction trade journals specified by the Commission.

  2. If the product or service is proprietary in nature such that it can be obtained only from a certain contractor or contractors, the notice inviting informal bids may be sent exclusively to such contractor or contractors.

B. The notice inviting informal bids shall describe the project in general terms, how to obtain more detailed information about the project, and state the date and time and place for submission for the bid.

C. All mailings of notices of contractors and construction trade journals pursuant to this section must be completed not less than ten calendar days before bids are due.

3.36.050 - Award of contracts.

The county administrative officer or the director of public works, or their designees, are authorized to award informal contracts following the informal bidding process described in Section 3.36.020 and, with respect to such contracts, to issue change orders in accordance with Public Contract Code Section 20142, as the same may be amended from time to time. The county board of supervisors may delegate the authority to award informal contracts to a different person when necessary.

3.36.060 - Excessive bid amounts.

If all bids received are in excess of one hundred twenty-five thousand dollars, the board of supervisors may with the passage of a resolution by a four-fifths vote, award the contract at one hundred thirty-seven thousand five hundred dollars or less to the lowest responsible bidder, if it determines that the cost estimate of the public works department was reasonable. Note: To the extent that California Public Contract Code Section 22034(f) is amended from time to time to permit higher dollar amounts for the above authorization, then those higher amounts are incorporated herein by this reference and shall govern said authorization.
