3.03.010 - Claims for money or damages.

Under Section 935 of the California Government Code, the claims procedures set forth in this chapter are established as a prerequisite to bringing suit against the county or against any officer, department, commission or board of the county, based on any claim for money or damages that is not otherwise governed by state or local laws relating thereto. This chapter shall relate only to the bringing of suit upon any claim, and is not deemed to apply to the authority of the auditor-controller, the county administrator, board of supervisors, and other officers to allow, compromise, settle, and pay, in the ordinary course of business, the just obligations of the county, including but not limited to the following: routine salaries and wages; principal and interest on bonds; payments for purchases and other such expenditures for which there is a budget appropriation or contractual obligation; and payments duly authorized by the board of supervisors or county administrator in order to allow, compromise, or settle a potential or anticipated claim prior to, or in the absence of, its formal presentation or assertion.

3.03.020 - Presentation procedure.

Notwithstanding the exemptions set forth in Section 905 of the California Government Code, all claims against the county for damages or money, when a procedure for processing such claims is not otherwise provided by state or local laws, shall be presented and acted upon within the time limitations and in the manner prescribed by Title 1, Division 3.6, Part 3 (commencing with Section 900) of the California Government Code and by this chapter.

3.03.030 - Claims of thirty thousand dollars or less—Delegation of authority.

Under Section 935.3 of the California Government Code, the board of supervisors does delegate to the county administrator or his designee the authority to perform those functions of the board prescribed by Title 1, Division 3.6, Part 3 (commencing with Section 900) of the California Government Code with respect to any claims seeking thirty thousand dollars or less from the county. The board further authorizes the county administrator to allow, compromise, or settle any such claim against the county, including any anticipated or potential claims that have not been formally presented or asserted. Upon written order of the county administrator, the county's auditor-controller shall cause a warrant to be issued upon the county treasury in the amount for which a claim has been allowed, compromised, or settled.

3.03.035 - Workers' compensation claims.

In addition to any contracts for services related to workers' compensation claims that the board may approve from time to time under Government Code Section 31000.8, the board of supervisors does authorize the county administrator (and any deputy county administrator that he or she may designate) to perform all of the services and functions related to workers' compensation for which it may contract under said section. Expressly included within said authorization shall be the authority to approve any claim settlement in the amount of twenty thousand dollars or less.

3.03.040 - No limitation of authority.

Nothing in this chapter shall be deemed or construed as limiting the authority of the board of supervisors or the county administrator to allow, compromise, or settle a potential or anticipated claim against the county prior to, or in the absence of, its formal presentation or assertion. Such authority is expressly reserved and confirmed.
