8.02.010 - Definitions.¶
The terms which are used in this chapter, shall have the respective following meanings:
A. "County disposal site" includes both "county landfill" and "county transfer station." "County landfill" means the Alturas landfill which has been designated by the board of supervisors for the specific purpose of land disposal of class III waste. "County transfer station" means one or more of those sites, which shall have been designated by the board of supervisors for the collection of class III waste to be transported to the Alturas transfer station and then to an approved ultimate disposal site.
B. "Demolition" means materials derived from demolishing structures and excess construction materials approved to be disposed of at a class III site.
C. "Garbage" means and includes kitchen and table refuse, offal, swill and also every accumulation of animal and/or vegetable refuse and other matter that attends the preparation, consumption, decay, or dealing in or storage of, fish, meats, fowl, birds, fruits or vegetables. It shall also include crockery, bottles, plastics, tin or aluminum cans, combustible waste and refuse matter, ashes, and all of any refuse, except that it shall not include (1) byproducts of butcher shops, or fresh vegetable stores, where the byproducts have a commercial value and are not decomposed, not offensive, and have not been rejected by the owners or producers thereof as offensive or useless; or (2) "wet garbage" or "rubbish" as defined in this section.
D. "Checker-collector" means an employee of the waste disposal contractor designated by the county public works department to evaluate and collect fees pursuant to the "fee schedule for county disposal sites" in Section 8.02.030.
E. "Refuse" means and includes all materials which have ceased to have any immediate utility to the owner thereof, and which are likely to attract, or be consumed by flies, rodents or other insects or animals, which, if permitted to remain in the place or condition where the owner or possessor thereof has permitted them to remain, infection is likely to arise, remain or spread, or are or may become a hazard of fires, health or safety.
F. "Rubbish" means and includes all waste and refuse matter except demolition, garbage and wet garbage, which are ordinarily accumulated in and about residences, office buildings, apartment houses, lodging houses, hotels, restaurants, stores, shops, offices and other buildings. Rubbish includes lawn and weed clippings and tree trimmings.
G. "Septage" means septic tank sludge pumpings.
H. "Wet garbage" means all clean refuse which is suitable for feed for hogs, that comes from hospital kitchens or from county-permitted restaurants, grocery stores or butcher shops. It shall consist of and include only such kitchen refuse, offal and swill and every accumulation of animal and vegetable waste from establishments where foodstuffs intended for human consumption are handled commercially. It shall not include the byproducts of butcher shops or grocery stores where such byproducts have a commercial value and are neither decomposed nor offensive and have not been rejected by the owners or producers thereof as offensive or useless.

8.02.020 - Establishment of solid waste enterprise fund.¶
A solid waste enterprise fund is created for all revenue collected from the imposition of fees charged at each county operated solid waste disposal site, whether landfill or transfer station. Moneys on deposit in such enterprise fund shall be used only for the acquisition, construction, administration, operation and maintenance of county waste disposal sites and for financing solid waste handling and disposal sites.

8.02.030 - Establishing fees at county waste disposal sites.¶
Fees shall be charged and collected at all county disposal sites in accord with the following "fee schedule for county disposal sites." Fees shall be payable in legal tender of the United States of America.

Annual adjustment for contract mandated increases.
In addition to the rates set forth above, annually, the county will increase each rate by the percent necessary to cover the costs increase (if any) required of the county by the refuse collection agreement entered into between the County of Modoc and USA Waste of California, Inc., d.b.a. Alturas Disposal, entered into on March 2006.

8.02.040 - Waste disposal sites to be operated by county public works department-Method of collection.¶
County operated solid waste disposal sites shall be operated under the supervision of the county public works department, and operated by the county designated contractor. Fee rates shall be conspicuously posted at all disposal sites. It shall be the duty of a checker-collector to designate the fee to be collected in accordance with the fee schedule. All persons using a disposal site, upon paying a fee, shall be furnished a receipt therefore.

8.02.050 - Site operations.¶
No person shall dispose of solid waste at a county operated disposal site at other than the posted locations on-site or as directed by on-site authorized personnel. Open burning at a disposal site, other than by authorized personnel is prohibited. Scavenging also prohibited.

8.02.060 - Site hours.¶
County disposal sites shall be open during hours which shall from time to time be set by resolution of the board of supervisors.

8.02.070 - Prohibited wastes.¶
Hazardous wastes (as defined by the California Department of Health Services), or designated wastes which require special handling (as defined by the California Regional Water Quality Control Boards) are prohibited from entering county disposal sites. Septage and dead animals will be accepted at the Alturas landfill only. Car bodies will be accepted at the Alturas landfill and the Lake City transfer site only, with the appropriate documentation.

8.02.080 - Prohibited dumping.¶
A. No person shall throw or deposit, or cause to be thrown or deposited any garbage, rubbish, or refuse, or allow any accumulation of same to remain, in or upon any public right-of-way, watercourse, or banks of watercourses, or upon any premises whatsoever except at an approved county disposal site.
B. There shall be no dumping of solid waste on private or public property other than provided by this chapter except by special written permission of the board of supervisors. This section shall not be construed to prevent property owners from placing litter receptacles on their property to prevent an accumulation of litter.
C. Disposal sites may be granted to other agencies and individuals according to the requirements and procedures of the Modoc County solid waste management element of the county general plan, the California Environmental Quality Act, and the permitting requirements of federal and state agencies.
