8.08.010 - Findings concerning plant diseases.

Stem and bulb nematode and white rot are diseases of garlic which cause severe damage to garlic yields. These diseases are transmissible with the plant tissue of garlic. Their appearance within the county would be injurious and detrimental to the garlic growing industry of the county.

8.08.020 - Planting permit required—Issuance conditions.

It is unlawful for any person, firm or corporation to plant or grow garlic for commercial production within the county without first applying to the agricultural commissioner of the county for a permit to plant such seed or stock. The application shall be in writing, and shall be in such form and give such details as the agricultural commissioner may require. If the agricultural commissioner, after investigation, determines that the garlic is free of stem and bulb nematode and white rot, he shall issue a permit authorizing the applicant to plant such garlic.

8.08.030 - Inspection authorized when.

The county agricultural commissioner shall, whenever he deems it necessary, cause an inspection to be made of planted garlic, or garlic intended for commercial planting, such inspection to determine the existence of stem and bulb nematode and white rot.

8.08.040 - Violation—Penalty.

Any violation of the provisions of this chapter shall constitute a misdemeanor, and shall be punishable by a fine of not more than five hundred dollars, or by imprisonment in the county jail for a period of not to exceed six months, or by both such fine and imprisonment.
