Modoc County Municipal Code Ch. 3.54 Criminal Justice Administrative Fee

A. Pursuant to Government Code Section 29550 a county is authorized to impose a fee upon a city for reimbursement of county expenses incurred with respect to booking or other processing of persons arrested by an employee of that city where the arrested persons are brought to the county jail for booking or detention.

B. The fee imposed pursuant to Government Code Section 29550 shall not exceed the actual administrative costs, including applicable overhead costs as permitted by Federal Circular A-87 Standards, incurred in booking or otherwise processing arrested persons.

C. Pursuant to Government Code Section 29550 a county may submit an invoice to a city for the fee imposed pursuant to this section on and after July 1, 1990.

Pursuant to Government Code Section 29550 a criminal justice administrative fee is hereby imposed upon all incorporated cities within the county for the booking or other processing of persons arrested by an employee of that city where the arrested persons are brought to the county jail for booking or detention in the amount of fifty dollars and eighty-four cents per individual booked or otherwise processed. The fee shall apply to all arrests resulting in booking or detention at a county jail on and after July 1, 1990. In those situations involving an arrest by warrant, a booking fee will be imposed where an arrest is pursuant to a warrant only in those instances where the arresting officer is an employee of the agency that initiated the warrant. The amount of the fee set forth in this section does not exceed the actual administrative costs, including applicable overhead costs permitted by Federal Circular A-87 Standards, incurred in the booking or other processing of arrested or detained persons.

For purposes of this ordinance an "employee" shall include any person making an arrest on behalf of an incorporated city.

The county auditor shall calculate the fees described herein annually and the amount set forth in Section 3.54.010 may be amended annually in accordance with the auditor's calculations by resolution of the board of supervisors.
