3.06.020 - Intercounty disaster relief.

Pursuant to the provisions of section 69.3 of Chapter 2 of Part 0.5 of Division 1 of the California Revenue and Taxation Code, the base year value of property substantially damaged or destroyed in a governor-declared disaster may be transferred to a comparable replacement property of equal or lesser value located in Modoc County; provided, that:

A. The original property is owned and occupied by the claimant and his/her principal place of residence;

B. The original property has sustained physical damage amounting to more than fifty percent of its full cash value immediately prior to the disaster;

C. The comparable replacement property is of equal or lessor value than the original property full cash value prior to the disaster;

D. The replacement property has been acquired or newly constructed as a replacement for the damaged/destroyed property within three years after the damage/destruction of the original property; and

E. The governor-declared disaster occurred after October 20, 1991.
