It shall be unlawful for any minor to remain or loiter upon any street, sidewalk, park or other public place or place open to the public within the City of Milpitas between the hours of 10 p.m. and 5 a.m. of the following day except as hereafter provided.

This Chapter shall not apply to any minor who:

2.01 Is accompanied by a parent, legal guardian or other adult having the care and custody of said minor.

2.02 Is attending or has attended a night class, library study, theater, dance, game, recreational activity or other function sponsored by a school, church, youth philanthropic organization or community service organization and while said minor is going directly to said activity from his residence or coming directly from said activity to his residence.

2.03 Is required to be present in such place or places in connection with some lawful trade, business, profession, or occupation in which said minor is lawfully engaged with the written consent of the parent or legal guardian of said minor.
