4.08.010 - Permit required.

It shall be unlawful for the owner, manager, proprietor or any other person having charge of any public bathhouse, social club, theater, billiard or pool room, public shooting gallery, public bowling alley or other place of public amusement to keep the same open, to maintain or operate the same or to allow any person to use the same until a permit for the carrying on and conducting of such business has been obtained.

4.08.020 - Granting of permit.

No license to conduct, manage or carry on any bathhouse, social club, theater, billiard or pool room, public shooting gallery, public bowling alley or other place of public amusement shall be issued to any person until a permit has been granted therefor by the Council. No such permit shall be granted except upon the written application of the person desiring the same, and the filing of the application with the Council stating the place where such business is to be located. No permit shall be granted to any person for a license to conduct, manage or carry on any of the businesses enumerated until such application has been filed.

A. Special permits for pool tables in bars or restaurants. As an exception to the provisions of Section 4.08.020, where no more than two (2) pool tables which are coin-operated are maintained in an establishment which principal business is that other than a billiard parlor or pool room, a permit may be issued by the Licensing Authority, as designated in Section 6.01.250 of this Code, for the operation of not to exceed two (2) pool tables. Said permit may be renewed annually upon application being made by the permittee to the Licensing Authority and approval of said application pursuant to the following procedure: Upon filing of the application by permittee, the Licensing Authority shall request a report from the Chief of Police; upon receipt by the Licensing Authority of a favorable report from the Chief of Police on the permit renewal application, the permit shall be renewed by the Licensing Authority. In the event an unfavorable report is made by the Chief of Police, the renewal of the permit shall be denied by the Licensing Authority. The applicant may appeal the denial of the permit to the Council as provided in Chapter 1.12, Title 1 of this Code (Sections 1.12.010 to 1.12.030, inclusive) and the decision of the Council shall be final. The provisions of Section 1.12.030 are applicable to the provisions of this section and the permit so issued shall be subject to the provisions of Section 4.08.040 of this chapter.

4.08.030 - Rules and regulations.

The Council shall have authority upon the granting of any permit required by this chapter to impose such rules and regulations as may be deemed proper and necessary for the maintenance of public order, the promotion of public morals, the orderly conduct of such places, or the better enforcement of the provisions of this chapter, and to alter or amend such rules and regulations from time to time, and to revoke the permit of any person who shall neglect or refuse to comply with the same. In issuing permits, the Council may also satisfy itself that the conduct of such places of business or amusement will comport with the public welfare and may consider any facts or evidence bearing on the place where such business or places of amusement are to be located, the character, reputation and moral status of those who will be in charge of it, and any other facts or evidence tending to enlighten the Council in such respect.

4.08.040 - Revocation of permit.

Any person who shall violate any of the provisions of this chapter shall be deemed guilty of a misdemeanor and, upon conviction, any permit which may have been granted to such person or to the proprietor or owner of the business or places of amusement which such person was operating shall immediately be rendered void and revoked without further action. No new permit shall thereafter be issued to such person.
