Article 17 — TRAFFIC DEVELOPMENT IMPACT FEES

§ 9-2.1701. Authority, general purpose, and definitions. ¶
This article is adopted pursuant to the provisions of Chapter 4.7 of Division 1 of Title 7 of the Government Code of the State. It is the purpose of this article to provide fees to be used for traffic management, including signalization and various traffic signs, plus traffic related equipment, such as signal energizers throughout the City, in connection with the development of new residential, commercial, and industrial uses.

§ 9-2.1702. Traffic impact fees. ¶
The City has agreed to impose traffic impact fees on all new development and redevelopment at the rates set forth by City Council resolution.

§ 9-2.1703. Requirements. ¶
Upon the issuance of a building permit for new development and redevelopment, traffic impact fees shall be paid in accordance with the adopted traffic impact fee schedule. Such fees are based on the ITE Land Use Code and square foot-age for commercial and industrial uses. (§ 1, Ord. 781, eff. September 16, 1988)
§ 9-2.1704. Conditions. ¶
(a) Fees shall be reviewed on an annual basis (January 1st) by the Council, City Manager, and staff. Adjustments shall be made based on the traffic minimum volume, warrant signalization costs, and ADT factor, times the independent variable, equaling the traffic impact fee rates.
(b) Development which produces a higher traffic minimum volume than normal or, because of its location has a special impact on a traffic condition, as documented by any environmental action or traffic study, may be assessed on a case by case basis at a rate above the normal fee structure.

§ 9-2.1705. Adoption of fees. ¶
The traffic impact fees shall be adopted by resolution of the Council. (§ 1, Ord. 781, eff. September 16, 1988)
§ 9-2.1706. Disposition of fees. ¶
All fees collected pursuant to this article shall be paid to the Director of Finance and shall be deposited into a Traffic Impact Fund or its successor. Money in said fund, including accrued interest, shall be expended solely for traffic signalization and various traffic signs, plus traffic related equipment, such as signal energizers.
