§ 9-3.2825. Unlawful signs. ¶
Every sign in existence on December 4, 1987, and which was prohibited or illegal at the time of installation, and which does not conform to the provisions of this article, shall be an illegal sign. Such signs shall be removed immediately upon notification of illegality. Failure to remove such signs shall be in violation of this article. Signs which are not constructed, maintained, or displayed pursuant to
the requirements of this article, notwithstanding the other provisions of this article, for the purposes of this section, a change of copy or sign face shall not be deemed a discontinuance of use. However, for the purposes of this section, any structural alteration to any part of the sign shall be deemed a discontinuance of use. A nonconforming sign shall be made to conform immediately to the provisions of this article if:
(a) The owner, outside of a change of copy, requests permission to remodel and remodels a nonconforming sign display, or expands or enlarges the building or land use upon which the advertising display is located, or changes the use of the premises;
(b) The owner relocates a sign;
(c) There is an agreement between the owner and the City for the removal of a sign on a given date;
(d) The sign display is temporary;
(e) The sign display is or may become a danger to the public or is unsafe; or
(f) The sign display constitutes a traffic hazard.
