§ 10.58.010. Definitions.

As used in this chapter:

A "business district"

is defined, for purpose of this chapter, as any area within the city bordering one side of a local street or a highway for a distance of at least six hundred feet, or bordering both sides of a local street or a highway for at least three hundred feet where at least fifty percent of the property is occupied by buildings in use for business.

"Pedestrian walkway"

means an area within a shopping center, shopping district or business district which is closed to vehicular traffic and which is designed for pedestrian travel.

"Place of public assembly"

includes all buildings or areas where persons congregate from time to time including, but not limited to, any community or senior citizens' center, City Hall, library, any assembly hall and city parks.

"Rollerskate" or "rollerblade"

means any footwear or device which may be attached to the foot or footwear to which wheels are attached and such wheels may be used by the wearer in moving.

"Shopping district"

means a collection of individual stores and other commercial establishments standing on separate lots or parcels along street frontage or clustered in a contiguous area, with or without off-street parking.

"Skateboard"

means a board of any material which has attached wheels which may be used for movement or propulsion.

§ 10.58.020. Prohibited.

A. No person shall use a skateboard, rollerblades or rollerskates on a street, sidewalk, pedestrian walkway or parking area within a shopping district, business district or a shopping center.

B. No person shall use a skateboard, rollerblades or rollerskates in a manner which creates a nuisance. For purposes of this chapter, "nuisance" is defined as any activity which:

  1. Threatens injury to person or property;

  2. Creates an obstruction or presents a hazard to the free use of public or private property by pedestrians or motorists; or

  3. Generates loud or unreasonable noise.

§ 10.58.030. Prohibited in places or public assembly.

Where the prohibition has been posted pursuant to Section 10.58.040, no person shall use or operate any skateboard, rollerblades or rollerskates in any place of public assembly, including the parking lot and pedestrian walkways.

§ 10.58.040. Posting requirements.

The prohibition of using or operating skateboards, rollerblades or rollerskates has been properly posted if the prohibition sign is displayed in plain view at all entrances to the property on a sign not less than twelve inches by eighteen inches in size with lettering not less than one inch in height.

§ 10.58.050. Designated areas.

The city council may, from time to time, designate certain areas for skateboard use. Such areas shall be designated by resolution of the city council and posted with signs which are consistent with the standards for signs utilized by the department of public works.

A. The following regulations shall apply within the designated skateboarding areas:

  1. No person shall skate or skateboard at times other than those established as the hours of operation. The facility will be open for the community during nonschool hours;

  2. No person shall use the skateboarding areas for uses other than for skateboarding and in-line skating;

  3. No person shall use the designated skateboarding areas unless they wear proper safety equipment including a helmet, elbow pads, and knee pads;

  4. No person shall ride or cause bicycles to be on the skating surface of the skateboarding area;

  5. No person shall use alcohol or drugs in the designated skateboarding area;

  6. All persons using the skateboarding area must place trash in cans provided by the city or such persons shall be removed from the designated skateboarding areas;

  7. No person shall cause graffiti or tagging of skateboarding area;

  8. No person shall skate on the curbs, sidewalks, driveways or parking lot of the city-owned or school district-owned areas surrounding the skateboarding areas.

B. A violation of any section or subsection in this chapter is deemed to be an infraction and is punishable as such according to the provisions of this Code and state law.
