2.46.010 Authority to arrest provided to authorized public safety officers.

Pursuant to the provisions of California Penal Code Section 836.5, designated public safety officers of the city of La Mirada are given authority to arrest which may be exercised solely in accordance with the provisions of this chapter. Each such designated public safety officer may exercise arrest authority in connection with a misdemeanor occurring in his or her presence which is a violation of a statute or ordinance which such officer has the duty to enforce. Only those public safety officers designated in writing by the city manager shall have the authority to arrest as provided in this chapter.

2.46.020 Issuance of a notice to appear .

In any case in which a person is arrested by a designated public safety officer and such person does not demand to be taken before a magistrate, the arresting officer shall prepare a written notice to appear and shall release the person on his or her promise to appear, in accordance with the provisions of California Penal Code Sections 836.5(c) and 853.6.

2.46.030 Conformance with policies and procedures .

Each designated public safety officer authorized to arrest pursuant to this chapter shall, at all times while exercising such authority, conform with all city policies and the procedures applicable thereto. Nothing herein shall authorize any public safety officer to carry a firearm.
