2.40.010 Required--Form .¶
All officers, full-time employees, and all members of all boards, commissions or committees of the city shall take and subscribe the following oath or affirmation within thirty days from date of appointment:
"I, , do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and the Constitution of the state of California against all enemies, foreign and domestic; that I will bear true faith and allegiance to the Constitution of the United States and the Constitution of the state of California; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties upon which I am about to enter.

2.40.030 Failure to take oath .¶
Any officer, full-time employee or member of any board, commission or committee of the city who has not taken and subscribed the oath or affirmation as set forth in Section 2.40.010, shall within thirty days after November 10, 1977, take and subscribe such oath. In the event any officer, employee or member of any board, commission or committee of the city fails or has failed to take and subscribe such oath within thirty days after November 10, 1977, such person shall no longer be eligible to hold such office or position with the city.

2.40.040 Applicability .¶
Pursuant to the provisions of Article XX, Section 3 of the Constitution of the state of California, the provisions of this chapter shall not be deemed to apply to any member of the city council.

2.40.050 Severability .¶
If any section, subsection, sentence, clause, phrase or portion of this chapter is for any reason held invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this chapter. The city council hereby declares that it would have adopted this chapter and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, phrases or portions be declared invalid or unconstitutional.
