§ 2.14.010. Established.

The city parks and recreation commission is established.

§ 2.14.020. Eligibility and appointment.

The city parks and recreation commission shall consist of five members. Persons who are residents of the city or who are employed within the city, or who reside in unincorporated areas of Monterey County within ten miles of the city boundaries, shall be eligible for appointment as members of the commission, except a majority of the commission shall at all times be composed of residents of the city. In the event that as a result of resignation or terming out, more than half of the commission is composed of nonresidents of the city, the commission shall suspend its meetings until through appointment at least half of the commission members are residents of the city. At the first meeting of each calendar year, the committee shall elect a chairperson and a vice chairperson within its membership, who shall serve until the first meeting of the following year. A chairperson and vice chairperson may be elected for successive terms, without restriction as to number.

§ 2.14.030. Ex officio members.

The city manager, director of community development, and director of parks and recreation may sit as ex officio members without vote, provided such positions are filled by duly appointed persons.

§ 2.14.040. Secretary.

When the position of parks and recreation director may be authorized by the city council, the director shall serve as secretary to the parks and recreation commission. In the absence of an appointed director, the commission shall appoint one of its members to act as secretary.

§ 2.14.050. Terms.

The term of office of the members of the commission first appointed shall commence on the effective date of the ordinance codified in this chapter, three members to be appointed for two years and two members to be appointed for four years. Thereafter, the term of office of the members of the commission shall be for four years.

§ 2.14.060. Vacancy or removal.

Any appointee member may be removed by a majority vote of the city council. Any appointee member who misses three consecutive regular meetings without an excused absence shall be considered a disinterested party and the recreation commission shall request their removal and subsequent replacement by another appointee. If a vacancy occurs other than by expiration of a term, it shall be filled by the mayor’s appointment for the unexpired portion of the term.

§ 2.14.070. Chairperson.

The commission shall elect its chairperson and vice-chairperson from among its members. The term of office shall be one year unless the term of the officer as a member of the commission expires sooner in which case a successor shall be selected by the commission to act as chairperson for the unexpired term remaining.

§ 2.14.080. Meetings.

The city parks and recreation commission shall establish a regular place of meeting and rules of conduct thereof, and shall hold at least one regular meeting each month. Special meetings of the commission may be called at any time by the city council, by the chairperson, or by any four or more members of the commission upon personal notice being given to all members of the commission. If personal notice cannot be given, written notice must be mailed to such members at least twenty-four hours prior to the meeting, unless said notice requirement is waived in writing by said member.

§ 2.14.090. Organization and procedure.

A majority vote is required to approve a recommendation or on any matter that is presented to the commission which requires a vote. A quorum shall consist of four appointed members of the commission. The commission shall keep an accurate record of its proceedings and transactions, and through the secretary shall render such reports to the city council as may be required.

§ 2.14.100. Powers and functions.

The powers and functions of the city parks and recreation commission shall be as follows:

(1) To hold hearings on matters pertaining to maintenance of park sites, capital expenditures and municipal activities in relation to parks and recreation, including the municipal golf course;

(2) To conduct such other hearings as are necessary and in accordance with its own rules and regulations;

(3) To report its decisions and recommendations in writing to the city council;

(4) To consider, formulate and provide surveys, maps and plans designated to provide for, regulate and direct the future growth and development of the parks and recreation system in order to secure to the city of King and its inhabitants better service;

(5) To make investigations and reports for future acquisition of park sites;

(6) To make, in its advisory capacity, any and all recommendations to the city council relating to the above matter;

(7) In cooperation with such city staff appointees that shall be designated by the city manager, the commission will consider, review and evaluate all parks and recreation programs.

§ 2.14.200. Procedural rules.

The city park and recreation commission may adopt from time to time such rules of procedure as it may deem necessary to properly exercise its functions. Such rules shall be recommended to the director of parks and recreation or city manager, and shall be subject to approval by the city council before becoming effective. All such rules shall be kept on file with the chairperson of the city park and recreation commission, the department office and the mayor, and a copy thereof shall be furnished each commissioner and any other person upon request.

§ 2.14.300. Coordinating powers.

The chairperson of the city park and recreation commission with the approval of the commission and the director of parks and recreation is authorized and empowered to call upon, have appear or receive from any councilmember, city employee, county employee or any other qualified person, information and advice to effect the general purposes of this chapter. Should it be necessary to employ for compensation any services pursuant to this section, the chairperson shall submit a report of facts outlining the program to the city council through the city manager or director of parks and recreation and shall receive from the city council through the city manager authorization for said expenditure.
