§ 2.11.010. Applicability.

The provisions of this chapter shall apply to all boards, commissions and committees of the city. In case of conflict between this chapter and any other provisions of the King City Municipal Code, the provisions of this chapter shall control.

§ 2.11.020. Membership—Appointment.

(a) All boards, commissions and committees shall consist of five members unless otherwise expressly provided by the city council. Appointments shall be made by the council.

(b) Only residents of the city shall be eligible for appointment to the planning commission. In the case of the parks and recreation commission, persons who are residents of the city or employed in the city and who reside in the unincorporated areas of Monterey County within ten miles of the city may be appointed but not comprise a majority of the commission.

(c) Only persons having an active interest in the airport, as defined by personal, business or professional activities associated with the airport may be appointed to the airport advisory committee.

(d) With the exception of the architectural committee (Section 17.50.020 of this code) no person shall serve on more than one board, commission or committee at any given time.

§ 2.11.030. Terms.

Each appointment shall be for a term of four years, except that persons appointed to a vacancy created by the resignation or removal of a member shall serve for the unexpired term of such exiting member. If a new committee is created by action of the council, the initial terms of such appointees shall be staggered so that two of the initially appointed members’ terms shall expire in two years from their appointment.

§ 2.11.040. Removal.

All members of boards, commissions, and committees serve at the pleasure of the city council and can be removed for any or no reason. The seat of any member of any board, commission or committee shall be declared vacant if the member has three consecutive unexcused absences from meetings, or misses more than twenty-five percent of meetings within the same calendar year without excuse. The determination of such vacancy shall be made by the city manager and subject to appeal to the city council.

§ 2.11.050. Filling vacancies.

(a) Whenever a vacancy is caused by resignation, removal or death of a member of a board, commission or committee, the city clerk shall advertise such vacancy by publication in a newspaper of general circulation printed, published or circulated in the city, and posting notice of such vacancy in a conspicuous place in City Hall. Such notices shall describe the position to be filled, and invite interested persons to apply for appointment thereto.

(b) When a member’s term is expiring, the city clerk shall advertise the opening at least three months before the expiration of the term in the same manner as in the previous subsection. The clerk shall also advise the member whose term is expiring that he or she may apply for reappointment.

(c) In advertising to fill vacancies in the city’s airport commission, the city clerk shall state in the city’s notices advertising the vacancy that persons with aviation or airport management experience are encouraged to apply.

(d) Vacancies shall be advertised for thirty days. In the event there are no applicants, the city clerk shall notify the council and may extend the recruitment another thirty days.

(e) The mayor, or designee from the council, the chair of the affected board, commission or committee, and the city manager or designee, shall jointly interview applicants and recommend appointments to the city council.

(f) The city council shall consider the recommendation and appoint members by resolution.

(g) All appointments are for four years.
