14.26.020 - Generally.

The definitions given in this article shall be used in the interpretation of this chapter, the issuance of permits and all other operations of this chapter unless another meaning for the word is apparent from the context.

14.26.030 - Chief engineer.

"Chief engineer" means the director of the engineering and survey services department or his authorized designee.

14.26.040 - County.

"County" means the county of Kern.

14.26.050 - Discharger.

"Discharger" means any person that discharges or causes a discharge to a storm drain.

14.26.060 - Garbage.

"Garbage" means putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.

14.26.070 - Industrial stormwater.

"Industrial stormwater" means those flows resulting from precipitation originating upon or flowing across industrial uses, as specified in the California Water Resources Control Board's General Industrial Storm Water Permit adopted November 19, 1991, prior to discharging into county maintained and operated stormwater systems or facilities.

14.26.080 - Inspector.

"Inspector" means a person authorized by the chief engineer to inspect stormwater generation, conveyance and disposal facilities.

14.26.090 - Litter.

"Litter" means garbage, refuse, and rubbish as defined herein and all other material which, if thrown, deposited, or allowed to accumulate as herein prohibited, tends to create a danger to public health, safety and welfare, and which is not within a receptacle provided therefor.

14.26.100 - Ordinance.

"Ordinance" means, unless otherwise specified, the ordinance from which this chapter derives, also known as the Kern County Stormwater Ordinance. The words "ordinance" and "chapter" as used herein are interchangeable.

14.26.110 - Person.

"Person" means any individual, partnership, committee, association, corporation, public agency, and any other organization or group of persons, public or private.

14.26.120 - Refuse.

"Refuse" means all putrescible and nonputrescible solid wastes (except human body waste) including garbage, rubbish, ashes, street cleanings, dead animals, animal feces, and solid market and industrial wastes.

14.26.130 - Rubbish.

"Rubbish" means nonputrescible solid waste consisting of both combustible and noncombustible wastes including, but not limited to, paper, wrappings, cardboard, tin cans, weeds, dry grasses, dead trees and shrubs, yard clippings, leaves, dirt (other than the natural soil, in place), pieces of broken asphalt or concrete, wood, glass, bedding, crockery, and similar materials.

14.26.140 - Sanitary wastewater.

"Sanitary wastewater" means wastewater discharging from the sanitary conveniences of dwellings (including apartments and hotels), office buildings, industrial plants and institutions.

14.26.150 - Shall and may.

"Shall" is mandatory and "may" is permissive.

14.26.160 - Stormwater.

"Stormwater" means precipitation runoff, surface runoff, street wash waters related to street cleaning or maintenance, infiltration (other than infiltration contaminated by seepage from sanitary sewers or other discharges), drainage related to storm events or snow melt, and any other water approved by the chief engineer.

14.26.170 - Stormwater system.

"Stormwater system" means those curbs, inlets, underground conduit, retention/detention basins, outfalls, ditches, and canals used to collect, transport, infiltrate/evaporate or discharge stormwater.
