Sec. 1.10.010. - Violations of Code.

It shall be unlawful for any person to violate any provision or to fail to comply with any of the requirements of this Code or the provisions of any code adopted by reference by this Code, including, but not limited to, county ordinances adopted by the city, or any provision of any ordinance of the city not included within this Code. Any person violating any such provisions or failing to comply with any of the mandatory requirements of this Code or any code adopted by reference by this Code or any other city ordinance shall be subject to the penalties and enforcement provisions of this Title.

Sec. 1.10.020. - Issuance of citations by designated officers and employees.

A. The city's Enforcement Officials may, pursuant to Section 836.5 of the California Penal Code and subject to the provisions of this section, arrest a person without a warrant whenever any such officer or employee has reasonable cause to believe that the person to be arrested has committed an offense in the officer's or employee's presence which he or she has the discretionary duty to enforce, and to issue a notice to appear, and to release such person on his or her written promise to appear in court, pursuant to Penal Code Section 853.6.

B. The city's Enforcement Officials may issue citations, notices to appear and other notices initiating procedures pursuant to the provisions of Chapters 1.10 and 1.15 of this Code.

C. No Enforcement Official, other than a peace officer, shall be authorized to make a misdemeanor arrest unless such person has received such training as prescribed by law.

D. As used in this Code, the terms "Enforcement Official" or "Enforcement Officials" shall mean:

(1) Members of the Riverside County Police Department or such other police agency under contract to provide police services to the city;

(2) Members of the Riverside County Fire Department or such other fire agency under contract to provide fire and emergency services to the city;

(3) Persons employed by the city whose job descriptions require the person to enforce the provisions of this Code, including, but not limited to, code enforcement officers, building inspectors, or park rangers.

(4) Such other employees of the city as may be designated by resolution of the City Council.
