PREFACE

This Code constitutes a recodification of the general and permanent ordinances of the City of Jurupa Valley, California.

Source materials used in the preparation of the Code were the Riverside County Code as it existed on July 1, 2011, which Code was adopted by City Ord. No. 2011-01 and continued by City Ord. No. 2011-10, and ordinances adopted by the City Council. By use of the comparative tables appearing in the back of this Code, the reader can locate any section of the County Code and any other City ordinance included in the Code.

A table listing the state law citations and setting forth their location within the Code is included at the back of this Code. When including new chapters in a document, the alphabetical arrangement of chapters is maintained when including new chapters.

Page Numbering System

The page numbering system used in this Code is a prefix system. The letters to the left of the colon are an abbreviation which represents a certain portion of the volume. The number to the right of the colon represents the number of the page in that portion. In the case of a title of the Code, the number to the left of the colon indicates the number of the title. The following are typical parts of codes of ordinances, which may or may not appear in this Code at this time, and their corresponding prefixes:

Index

The index has been prepared with the greatest of care. Each particular item has been placed under several headings, some of which are couched in lay phraseology, others in legal terminology, and still others in language generally used by local government officials and employees. There are numerous cross references within the index itself that stand as guideposts to direct the user to the particular item in which the user is interested.

Looseleaf Supplements

A special feature of this publication is the looseleaf system of binding and supplemental servicing of the publication. With this system, the publication will be kept up to date. Subsequent amendatory legislation will be properly edited, and the affected page or pages will be reprinted. These new pages will be distributed to holders of copies of the publication, with instructions for the manner of inserting the new pages and deleting the obsolete pages.

Keeping this publication up to date at all times will depend largely upon the holder of the publication. As revised pages are received, it will then become the responsibility of the holder to have the amendments inserted according to the attached instructions. ORDINANCE NO. 2017-17

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF JURUPA VALLEY, CALIFORNIA, ADOPTING AND ENACTING THE JURUPA VALLEY MUNICIPAL CODE CODIFYING THE ORDINANCES ADOPTED BY THE CITY COUNCIL SINCE INCORPORATION, REARRANGING AND RENUMBERING THE PROVISIONS OF EXISTING ORDINANCES IN TITLES RELATING TO ADMINISTRATION, REVENUE AND FINANCE, BUSINESS REGULATION, HEALTH AND SANITATION, ANIMAL CONTROL, PEACE, MORALS AND SAFETY, VEHICLES AND TRAFFIC, STREETS AND SIDEWALKS, SUBDIVISIONS AND ZONING, BUT MAKING NO SUBSTANTIVE CHANGES TO SUCH ORDINANCES; PROVIDING PENALTIES AND REMEDIES FOR VIOLATION OF THE MUNICIPAL CODE; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN; AND FINDING SUCH ADOPTION EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT

THE CITY COUNCIL OF THE CITY OF JURUPA VALLEY DOES ORDAIN AS FOLLOWS:

Section 1. The City Council of the City of Jurupa Valley does find, determine and declare that:

(a) The adoption of this Ordinance is not a "project" under the California Environmental Quality Act because the Ordinance does not involve any commitment to a specific project which may result in a potentially significant physical impact on the environment, as contemplated by Title 14, California Municipal Code of Regulations, Section 15378(b)(4) and merely rearranges, renumbers and makes minor modifications to existing ordinances in establishing the Jurupa Valley Municipal Code. The proposed ordinance is exempt from the requirements of the California Environmental Quality Act ("CEQA") and the City's CEQA Guidelines pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that this Ordinance to establishing the Jurupa Valley Municipal Code will have a significant effect on the environment. No new provisions have been added to the Municipal Code that did not exist under the existing ordinances either adopted by reference from the County of Riverside or adopted by the City Council since incorporation. No substantive amendments are being made to provisions of existing ordinances either adopted by reference from the County of Riverside or adopted by the City Council since incorporation. The non-substantive changes made to the existing ordinances in the Municipal Code adopted by the Ordinance include changing "County of Riverside" to "City of Jurupa Valley," changing "unincorporated areas" to "City," changing "Board of Supervisors" to "City Council," rearranging and renumbering the existing ordinance provisions to conform to standard municipal code organization. The new Municipal Code will not result in a permanent alteration of property nor the construction of any new or expanded structures or other direct or indirect physical changes in the environment.

(b) The proposed Jurupa Valley Municipal Code is consistent with the Jurupa Valley General Plan and each element thereof adopted on September 7, 2017 subject to the changes in zoning as provided in the General Plan.

Section 2. The "Jurupa Valley Municipal Code," on file in the Office of the City Clerk, consisting of Titles 1 through 15, each inclusive, is hereby adopted as the Municipal Code of the City of Jurupa Valley.

Section 3. All ordinances of a general and permanent nature enacted on or before the effective date of this Ordinance are repealed, including ordinances of the County of Riverside adopted by reference by the City Council through Ordinance Nos. 2011-01 and 2011-02, except for the following ordinances that shall remain in effect unless otherwise amended or repealed by action of the City Council: (1) ordinances intended to be included in the Municipal Code; (2) ordinances recognized and continued in force by reference in the Municipal Code; or (3) ordinances that are not intended to be included in the Municipal Code by as described in Chapter 1.05 of the Municipal Code. The repeal provided for in this Section shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance that is repealed by this ordinance.

Section 4. Unless another penalty is specifically provided, violations of the Municipal Code shall be punished or remedied as provided in Title 1 of the Municipal Code.

Section 5. Additions or amendments to the Municipal Code when passed in such form as to indicate an intention to make the same a part of the Municipal Code shall be deemed to be incorporated in the Municipal Code, so that reference to the Municipal Code includes the additions and amendments.

Section 6. Ordinances adopted after the effective date of this Ordinance that amend or refer to ordinances that have been codified in the Municipal Code shall be construed as if they amend or refer to like provisions of the Municipal Code.

Section 7. The City Clerk of the City of Jurupa Valley shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted in the manner required by law.
