6.28.010 - Curfew¶
It shall be unlawful for any minor under the age of 18 years, to loiter, idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, wharves, docks, or other public grounds, public places and public buildings, or places of amusement and eating places, vacant lots, or other unsupervised places, between the hours of 10:00 p.m. and daylight immediately following; provided, however, that the provisions of this section do not apply when the minor is accompanied by his or her parent or parents, guardian, or other adult person having the care and custody of the minor, or when the minor is upon an emergency errand directed by his or her parent or guardian or other adult person having the care and custody of the minor or when the minor is returning directly home from a meeting, entertainment, recreational activity or dance.
Each violation of the provisions of this chapter shall constitute a separate offense.
6.28.020 - Parent/guardian responsibility¶
It shall be unlawful for the parent, guardian or other adult person having the care and custody of a minor under the age of 18 years, to permit or allow such minor to loiter, idle, wander, stroll or play in or upon the public streets, highways, roads alleys, parks, playgrounds, wharves, docks, or other public grounds, public places and public buildings, places of amusement and eating places, vacant lots, or other unsupervised places, between the hours of 10:00 p.m. and daylight immediately following, contrary to the provisions of section 6.28.010 of this chapter.
Each violation of the provisions of this section shall constitute a separate offense.
6.28.030 - Violation¶
Any minor violating the provisions of section 6.28.010 of this chapter shall be guilty of a misdemeanor, and shall be dealt with in accordance with juvenile court law and procedure.
Any parent, guardian or other adult person having the acre and custody of a minor violating section 6.28.020 of this chapter shall be guilty of a misdemeanor, and upon conviction thereof shall for the first offense be fined not less than $25.00 nor more than $50.00, or be confined in jail not more than ten days, or punished by both such fine and imprisonment; for the second offense such person shall be fined not less than $50.00 nor more than $100.00 or be confined in jail not more than 30 days, or punished by both said fine and imprisonment; and for each subsequent offense such person shall be fined not less than $100.00 nor more than $500.00, or be confined in jail not more than 90 days, or punished by both said fine and imprisonment.
