6.04.010 - Public urination and defecation

It is unlawful for any person to urinate or defecate in either a public place other than a restroom, or in a place open to public view.

A. This section shall not apply to children under six years of age.

B. This section shall not apply to persons who, because of a medical condition, are unable to control urinary and/or defecatory functions.

6.04.020 - Public nudity

It is unlawful for any person to be visible in or from any public street, park, playground, beach or adjacent waters, located within the city, in such a manner that the genitals, vulva, pubis, pubic hair, buttocks, perineum, anus, anal region or pubic hair region of that person, or any portion of the breast at or below the upper edge of the areola thereof on any female person, is exposed to public view or is not covered by an opaque covering.

A. This section shall not apply to children under ten years of age.

B. This section shall not apply to live theatrical performances in a theater, concert hall, or similar establishment held in authorized venues for such performances.

6.04.030 - Enforcement and penalties

A. The chief of police of the city, and any sworn police officer of the city, shall enforce the provisions of this chapter.

B. Any person who violates any provision of this chapter is guilty of an infraction or a misdemeanor.

  1. If charged as an infraction, the penalty shall be a fine of $35.00 if paid within 21 days of the date the citation is issued. If the civil penalty is not paid within 21 days of the date the citation is issued, the amount of the civil penalty shall be increased to $70.00. The charge for a photocopy of a citation shall be $2.00.

  2. If charged as a misdemeanor, the penalty shall be a fine not to exceed $1,000.00, or imprisonment in the county jail for a period not to exceed six months, or both such fine and imprisonment.
