6.20.010 - Definitions

Dangerous or deadly weapons includes, but is not limited to: Any dirk or dagger; any knife with a blade three inches or more in length and any snap-blade or spring-blade knife regardless of the length of the blade; any ice pick or similar sharp stabbing tool; any straight-edge razor or any razor blade fitted to a handle; any dangerous or deadly weapon within the meaning of any law of this state restricting the use thereof; and any cutting, stabbing or bludgeoning weapon or device capable of inflicting grievous bodily harm; and any firearm other than:

(1) One carried pursuant to a valid permit issued by a duly authorized governmental authority; or

(2) Any ordinary rifle or shotgun lawfully carried for purposes of hunting or other lawful sport.

6.20.020 - Acts prohibited; exceptions

A. It shall be unlawful for any person, while carrying concealed upon his person any dangerous or deadly weapon, to loaf or loiter upon any public street, sidewalk or alley or to wander about from place to place with no lawful business thereby to perform, or to hide, lurk or loiter upon or about the premises of another.

B. It shall be unlawful for any person who has concealed upon his person or who ahs in his immediate physical possession any dangerous or deadly weapon to engage in any fight or to participate in any other rough or disorderly conduct upon any public place or way or upon the premises of another.

C. It shall be unlawful for any person who has concealed upon his person any dangerous or deadly weapon, to loiter about any place where intoxicating liquors are sold or any other place or public resort.

D. It shall be unlawful for any person to have in his possession, in any automobile, any dangerous or deadly weapon, but this restriction shall not be deemed to prohibit the carrying of ordinary tools or equipment carried in good faith for uses of honest work, trade or business, or for the purpose of legitimate sport or recreation.

E. No person shall fire or discharge any gun, cannon, rifle, pistol, slingshot, BB gun, pellet gun or firearm of any kind, or explode any fireworks within the city limits of the city. This provision shall not apply to any of the following

  1. The discharge of firearms by a peace officer in the performance of his duties or the use of firearms for self-defense.

  2. Shooting galleries and gun clubs, provided a permit is first obtained from the city council.

  3. The discharge of such fireworks as are defined and classified as "safe and sane fireworks" under the state fireworks law as contained in the California Health and Safety Code.

  4. Public displays of fireworks, or the discharge of fireworks on special occasions, such as Chinese New Year, provided that a permit is first obtained from the city council.

  5. The use of explosives for tree planting, construction, demolition or similar purposes, provided that a permit is first obtained from the city council.

6.20.030 - Permit—Issuance

Any person desiring to do any act for which a permit from the city council is required under section 6.20.010 of this chapter shall file a written application therefor with the city clerk. The city clerk shall refer said application to an officer of the city for investigation as follows:

In the case of shooting galleries and gun clubs, said application shall be referred to the police chief; in the case of the use of explosives, said application shall be referred to the building inspector; and in all other instances, said application shall be referred to the fire chief.

The officer to whom the application has been referred shall make an investigation and shall submit a report of his findings and recommendation for or against the issuance of the permit, together with his reasons therefor, to the city council. The city council shall, in its discretion, grant or deny the application subject to such reasonable conditions, if any, as it may prescribe.

6.20.040 - Sale of weapons

It shall be unlawful for any person, firm, co-partnership, association or corporation to sell at retail within the city any pistol, revolver or other firearm capable of being concealed upon the person, as such firearms are defined by the terms of chapter 339 of the Statutes of the State of California of the year 1923, without first procuring from said city a license to do so.

6.20.050 - License

Said license shall be in the form prescribed by the state attorney general, and shall be effective for not more than one year from the date of issue and shall be subject to the following conditions; and for breach of any of which the license shall be subject to forfeiture.

  1. The business shall be carried on only in the building designated in the license.

  2. The license or a copy thereof, certified by the issuing authority, shall be displayed on the premises where it can easily be read.

  3. No pistol or revolver shall be delivered on the day of the application for the purchase, and when delivered shall be unloaded and securely wrapped; nor unless the purchaser either s personally known to the seller or shall present clear evidence of his identity.

  4. No pistol or revolver, or imitation thereof, or placard advertising the sale or other transfer thereof, shall be displayed in any part of said premises where it can readily be seen from the outside.

6.20.060 - Penalty

Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not exceeding $500.00 or by imprisonment in the county jail, for not exceeding six months, or by both such fine and imprisonment.
