§ 2.98.010. Transfer of functions.

On the transition date, the mosquito abatement and control functions of the department of environmental health are transferred to the office of the agricultural commissioner/sealer of weights and measures.

§ 2.98.020. Mosquito abatement and control functions.

The mosquito abatement and control functions of the department of environmental health which are transferred to the office of the agricultural commissioners/sealer of weights and measures are as follows:

A. Administration and enforcement of the provisions of Chapter 7.30 of this code;

B. Administration and enforcement of the powers of a mosquito abatement district within the area of the Owens Valley mosquito abatement program; and

C. All other related duties and functions as determined by the county.

§ 2.98.030. Assets.

On the transition date, all assets of the environmental health department which were primarily devoted to the performance of mosquito abatement and control functions, shall become assets of the office of the agricultural commissioner/sealer of weights and measures.

§ 2.98.040. Personnel.

On the transition date, all employees of the environmental health department who are primarily devoted to the performance of mosquito abatement and control functions shall become employees of the office of agricultural commissioner/sealer of weights and measures at their existing or equivalent classifications, and at their existing salaries and benefits that include accrued and unused vacation, sick leave, flex time, health and pension plans. Further, employment seniority of an employee of the environmental health department on the transition date shall be counted towards seniority in the office of the agricultural commissioner/sealer of weights and measures and all time spent in the same, equivalent, or higher classification shall be counted toward classification seniority.

§ 2.98.050. Transition and transition date.

The transition date shall be July 1, 2004. On the transition date, the mosquito abatement and control functions of the environmental health department are transferred to the office of the agricultural commissioner/sealer of weights and measures, and the assets, personnel, and responsibilities of mosquito abatement and control functions are transferred to the office of the agricultural commissioner/sealer of weights and measures as provided by this chapter.
