Chapter 2.92 — JURORS' FEES AND MILEAGE RATES

§ 2.92.010. Authority.

Penal Code Section 1143 and Code of Civil Procedure Section196 authorize county government by ordinance to set fees for trial jurors in criminal and civil cases at the rates of between ten dollars and twenty-five dollars for each day's attendance but in no case less than ten dollars for each day's attendance.

§ 2.92.020. Intent.

The board of supervisors, in passing this chapter, intends to equalize the jurors' fees and mileage between the Superior Court and the Justice Court. (Ord. 406 § 2, 1981)

§ 2.92.030. Fees.

The fee of trial jurors for all courts in criminal and civil cases shall be ten dollars, in lawful money of the United States, for each day's attendance. (Ord. 406 § 3, 1981; Ord. 549 § 2, 1984)

§ 2.92.040. Mileage.

The mileage for jurors for all courts of Inyo County in criminal cases shall be computed at the rate of thirty cents per mile for each mile necessarily traveled in attending court, in going only. (Ord. 406 § 4, 1981)

§ 2.92.045. Grand jurors mileage fees.

  • A. Authority. Penal Code Section 890 and Government Code Section 68091 authorize county government by ordinance to set higher fees and travel and mileage reimbursements for grand jurors than those established by state statute.

  • B. Intent. The board of supervisors, in passing this section, intends to have the Inyo County grand jurors be paid higher fees, travel, and mileage reimbursements than those established by state statute.

  • C. Fees.

    1. Each person who is a member of the 2001-2002 Inyo County grand jury upon the effective date of the ordinance codified in this chapter shall be paid a one time lump sum payment of two hundred dollars. The provisions of this subsection apply only to members of the 2001-2002 Inyo County grand jury.

    2. Commencing upon the effective date of the ordinance codified in this chapter, all persons who are members of the Inyo County grand jury shall be paid fees as follows:

      • a. Subject to the limitation in subsection (c), twenty-five dollars per day for attendance at general grand jury meetings;
    • b. Subject to the limitation in subsection c. below, ten dollars per day for attendance at grand jury committee meetings; and

    • c. Compensation paid to a grand jury member for attendance at general grand jury meetings and/or committee meetings conducted on the same day, shall not exceed twenty-five dollars per day.

  • D. Travel and Per Diem Reimbursement. On the effective date of this ordinance, travel and per diem expenses of grand jury members will be reimbursed in the same amount and to the same extent the county reimburses its permanent status employees for such expenses.

§ 2.92.050. Authorization for payment.

The above mileage fees shall be paid by the treasurer of the county out of the general fund upon warrants drawn by the county auditor upon the written order of the judge of the court in which the juror was in attendance, and the treasurer shall pay the warrants.
