SEC. 9-2401. - DEFINITIONS.

The following words and terms used in this Article shall have the meaning ascribed to them in this section as follows:

(a) The word "tire" shall mean any pneumatic tire or solid tire manufactured for use on any type of motor vehicle or aircraft.

(b) The term "tire dealer" shall mean any person who engages in the business of selling, trading, installing or dealing in new or used tires for profit including auto dismantlers and wrecking yards.

(c) The term "Tire Processing/Transformation Facility" shall mean any facility that processes or transforms used or waste tires into products or commodities other than tires (crumb rubber, fuel, consumer products, etc.)

(d) The term "used tires" shall mean any pneumatic tire or solid tire manufactured for use on any type of motor vehicle or aircraft that could be resold or used for retreading.

The term "waste tire" shall mean a tire that is no longer suitable for its original intended purpose due to wear, damage or defect.

(f) The term "waste tire hauler" shall mean any person who engages in the business of collection and/or transportation of used or waste tires. (Added Ord. 92-63, § 1, 9-25-92).

SEC. 9-2402. - PERMIT REQUIRED.

Any person engaging in the business of a waste tire hauler within the City of Fresno shall have a valid waste tire hauler permit issued by the County of Fresno, Department of Health. Permitted refuse collectors hauling tires to a disposal facility in loads mixed with other solid waste, government agencies, and vehicles carrying five (5) tires or less are exempt from the provisions of this Artilce. SEC. 9-2403. - DISPLAY OF NAME AND PERMIT STICKER.

It shall be unlawful for any permit holder to use, or allow to be used, any vehicle to collect and/or transport used or waste tires within the City of Fresno unless such vehicle displays the name of the permit holder in printing a minimum of two (2) inches high on both sides of the vehicle. A current permit sticker shall be placed on the vehicle as directed by the Fresno County, Department of Health. Common carriers hired by a permitted waste tire hauler are exempt from this section. SEC. 9-2404. - USES OF PERMITTED WASTE TIRE HAULER REQUIRED.

It shall be unlawful for any tire dealer in the City of Fresno to contract with, or otherwise permit, any person to collect and/or transport used or waste tires unless that person holds a valid waste tire hauler permit or is exempted from the provisions of this Article, as per Section 9-2401. SEC. 9-2405. - WASTE TIRE MANIFEST.

(a) Tire dealers and waste tire haulers shall complete the applicable section of a Waste Tire Manifest (provided by the Fresno County Health Department) whenever used or waste tire are:

(1) collected from a tire dealer by a waste tire hauler;

(2) transported to a facility that receives used or waste tires for storage, processing, transformation or disposal;

(b) A copy of the applicable section of the Waste Tire Manifest shall be submitted by all tire dealers and waste tire haulers to the Fresno County Health Department within thirty (30) days of the date tires are transported.

(c) A copy of the Waste Tire Manifest shall accompany each shipment of used or waste tires being transported.

(d) Any fees for processing the Waste Tire Manifest shall be paid by the waste tire hauler. (Added Ord. 92-63, § 1 eff. 9-25-92).

SEC. 9-2406. - USE OF AUTHORIZED FACILITIES.

It shall be unlawful to transport used and waste tires to facilities which are not legally authorized by State or local regulations to accept tires for resale, recapping, recycling, processing, transformation, or disposal. Tire dealers and waste tire haulers shall retain copies of manifests and receipts or other appropriate documentation to verify that used or waste tires were transported to authorized facilities. SEC. 9-2407. - PENALTY.

Any person, firm, or corporation violating any provision of this Article shall be guilty of a misdemeanor. (Added Ord. 92-63, § 1 eff. 9-25-92).
