SEC. 9-1401. - PAINTING NUMBERS ON CURB PERMITTED.

Owners and occupants of property in the city may paint or employ persons to paint their address numbers on the curb in front of the property owned or occupied by them. (Orig. Ord. 4484).

SEC. 9-1402. - WORK TO BE PERFORMED BEFORE PAYMENT.

No person who engages in the business of painting house numbers on curbs shall accept any remuneration for such work until the work has been performed. (Orig. Ord. 4484).

SEC. 9-1403. - PERMISSION OF OWNER OR OCCUPANT REQUIRED.

No person shall paint house numbers on curbs without first obtaining permission from the owner or occupant of the premises to which the house number applies. (Orig. Ord. 4484).

SEC. 9-1404. - BUSINESS OF PAINTING HOUSE NUMBERS; DEFINITION.

For the purpose of this article, any person who, for a pecuniary or other remuneration, paints house numbers at two or more locations in the city in any one calendar year shall be deemed to be engaged in the business of painting house numbers. (Orig. Ord. 4484).

SEC. 9-1405. - SPECIFICATIONS AND STANDARDS.

(a) The numbers shall be painted on curbs at approximately the center of the property in accordance with the following specifications, to wit: black numerals not less than two and one-half inches high, which such black numerals shall be painted on a white background, which such white background shall be five and one-half inches high, and shall extend one and one-half inches in length beyond the ends of the numerals, but in no case shall such white background be longer than fourteen inches. The surface of the curb to be painted shall be dry and cleaned of all dust, dirt, oil and grease. The field or base coat on which the lettering is to be placed shall be applied in a neat and workmanlike manner with edges plumb and level and shall be applied of either of the following materials:

Aluminum Field.—Two coats General Paint Company's Quick Drying Aluminum Paint No. C-003.

White Field.—Two coats General Paint Company's Quick Drying Traffic Paint No. 3-221.

Lettering.—General Paint Company's Black "Flex".

(b) The manufacturer and trade names of the several products as hereinbefore specified are intended to establish a standard of type and quality, and shall not confine the selection of materials to any one manufacturer's products. Materials of equal quality manufactured by other recognized manufacturers proposed to be substituted for those specified, shall be submitted to the head of the Public Works Department for approval. SEC. 9-1406. - LICENSE AND BOND REQUIRED.

(a) No person shall engage in the business of painting house numbers on curbs in the city without first obtaining a city business license and furnishing a bond in favor of the city in the amount designated in the Master Fee Resolution, to be approved as to form by the City Attorney, and to be filed in the office of the City Clerk.

(b) Such bond may be given by a surety company or it may be executed by two or more persons who are residents of the city.

(c) The condition of such bond shall be that in the event the principal named in said bond shall faithfully perform his or its duty in the painting of house numbers on curbs in compliance with the provisions of this article, then said obligation shall be void. Otherwise, it shall remain in full force and effect. In the event the principal on such bond shall fail to comply with any of the provisions of this article in the painting of house numbers on curbs, or shall improperly paint house numbers on curbs, or shall refuse or neglect to correct or remove said numbers and painting from curbs after notice from the Public Works Director, then the Director may direct said work to be removed or corrected, and the cost and expense of such removal or correction, not exceeding the amount of the bond, shall be collectible from said principal and the surety or sureties on such bond.

(d) Each bond shall run for a period of time which shall expire on the thirtieth day of June of each year. (Orig. Ord. 4484; Am. Ord. 5327, 1958; Am. Ord. 80-132, §§ 6, 7, eff. 10-3-80).
