SEC. 9-2001. - DEFINITION.¶
(a) As used in this article, a picture arcade shall mean any place, building or portion of a building which is a public place or to which the public or a segment thereof is admitted, whether or not an admission fee is charged or whether or not attendance is conditioned upon presentation of a membership card or token or other membership identification, where one or more coin operated, slug operated, electrically, electronically or mechanically controlled still or motion picture machines, projectors or video display devices are maintained to show still or motion pictures or other video display materials to five or fewer persons per machine or projector at any one time.
(b) As used in this article, a live arcade shall mean any place, building or portion of a building which is a public place or to which the public or a segment thereof is admitted, whether or not an admission fee is charged or whether or not attendance is conditioned upon presentation of a membership card or token or other membership identification where one or more actors, performers, contortionists, or dancers perform(s) in the presence of and is visible to five or fewer persons per booth through an opening or window or mirror in the booth which is a barrier between the occupant or occupants of each booth in the live arcade. SEC. 9-2002. - VISIBILITY OF INTERIOR.¶
(a) No picture arcade shall be maintained or operated unless the complete interior of the picture arcade and each booth therein is visible from a single designated location that shall be manned at all times during business hours to ensure that all activity and every patron at a booth or in an aisle that is used to access a booth is visible without obstructure from the single designated location. That single designated location may be, but is not limited to, the center of any and each building, if the entire building is used as a picture arcade, or of each portion of the building which is used as a picture arcade, or to the entrance to any place not within a building or portion thereof which is used as a picture arcade.
(b) No picture arcade shall be maintained or operated wherein the entrance or opening to any booth used for the viewing of still or motion picture or other video displayed or presented materials is fully or partially closed by a door, curtain or any other item or object, or by any architectural design which prevents an unobstructed view at the entrance or opening to each booth of the conduct of each occupant.
(c) No live arcade shall be maintained or operated unless the complete interior of the live arcade and each booth therein is visible from a single designated location that shall be manned at all times during business hours to ensure that all activity and every patron at a booth or in an aisle that is used to access a booth is visible without obstruction from the single designated location. That single designated location may be, but is not limited to, the center of any and each building, if the entire building is used as a live arcade, or to the entrance to any place not within a building or portion thereof which is used as a live arcade.
(d) No live arcade shall be maintained or operated wherein the entrance or opening to any booth used for the viewing of one or more actors, performers, contortionists or dancers is fully or partially closed by a door, curtain or any other item or object, or by an architectural design which prevents an unobstructed view at the entrance or opening to each booth of the conduct of each occupant.
(e) Every picture arcade and every live arcade shall be equipped with overhead lighting of sufficient intensity to illuminate every place to which patrons are permitted access at an illumination of not less than one footcandle as measured at floor level at all times during business hours. SEC. 9-2003. - APPLICATION.¶
Any picture arcade and any live arcade lawfully in existence prior to the adoption of this article, made illegal hereby, shall conform to the provisions of this article within three months of the effective date of this article and as to any amendments hereto, within three months of the effective date of any amendments hereto.
