5-8.01 - Parade defined.

For the purpose of this chapter, "parade" shall mean any march or procession consisting of persons, animals, or vehicles, or combinations thereof, upon any public street, sidewalk, alley, or other public place, which march or procession does not comply with normal and usual traffic regulations or controls.

5-8.02 - Permits: Required.

No person shall conduct, manage, or participate in any parade without a written permit from the Chief of Police.

5-8.03 - Permits: Form.

The permit required by the provisions of this chapter shall contain the following information:

(a) The date of the parade;

(b) The organization applying for the permit;

(c) The event;

(d) The route; and

(e) The starting time.

5-8.04 - Permits: Issuance: Denial.

(a) Issuance. The Chief of Police shall issue the permit required by the provisions of this chapter if he finds that:

(1) The conduct of such parade will not substantially interrupt the safe and orderly movement of other traffic contiguous to the route of the parade;

(2) The conduct of such parade will not require the diversion of so great a number of police officers to properly police the line of movement and the areas contiguous thereto as to prevent normal police protection to the City;

(3) The conduct of such parade will not interfere with the movement of fire-fighting equipment en route to a fire;

(4) The conduct of such parade is not reasonably likely to cause injury to persons or property, to provoke disorderly conduct, or create a disturbance;

(5) The concentration of persons, animals, and vehicles at the assembly points of the parade will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to such assembly area; and

(6) Such parade will move from its point of origin to its point of termination expeditiously and without stopping en route.

(b) Denial. No permit shall be issued authorizing a parade if the Chief of Police finds that such parade is proposed to be held for the sole purpose of advertising any product, goods, wares, merchandise, or event and is designed to be held purely for private profit.

5-8.05 - Permits: Denial: Appeals.

The Chief of Police shall act upon the application for the permit required by the provisions of this chapter within ten (10) days after the filing of the application therefor. If the Chief of Police disapproves the application, he shall mail to the applicant, within ten (10) days after the date upon which the application was filed, a notice of his action stating the reasons for his denial of the permit. Any person aggrieved shall have the right to appeal the denial of a parade permit to the Council by filing a written notice thereof with the City Clerk within five (5) days after the notice of such action. The decision of the Council after a hearing on such appeal shall be final.
