Sec. 17-426. - Designation and penalties.

(a)

Whenever the city council, by ordinance, designates and describes any street or portion thereof as a street the use of which is permitted by any commercial vehicle (as defined by California Vehicle Code Section 260) exceeding a manufacturer's gross vehicle weight rating of 10,000 pounds, the city engineer or city traffic engineer is authorized and directed to erect appropriate signs indicating the streets affected by the ordinance or not affected by the ordinance.

(b)

When such commercial vehicle routes are established and designated by appropriate signs, the operator of any commercial vehicle exceeding a manufacturer's gross vehicle weight rating of 10,000 pounds shall drive on such routes and none other, except as otherwise provided in section 17-427.

Appropriate signs may be erected for streets or portions thereof, as the city engineer or city traffic engineer determines will best serve to give notice of the prohibition of commercial vehicles exceeding a manufacturer's gross vehicle weight rating of 10,000 pounds.

Any person violating any provision of this article shall be guilty of an infraction.

Sec. 17-427. - Exceptions.

(a)

The operator of any commercial vehicle exceeding a manufacturer's gross vehicle weight rating of 10,000 pounds coming from a truck route having ingress and egress by direct route to and from restricted streets may drive on such restricted streets when necessary for the purpose of making pickups or deliveries of goods, wares or merchandise from or to any building or structure located on such restricted streets or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure adjacent to such restricted streets for which a building permit has previously been obtained.

(b)

The provisions of this article shall not apply to:

(1)

Passenger buses under the jurisdiction of the public utilities commission or any public agency.

(2)

Any vehicle owned by a public utility while being used in the construction, installation or repair of any utility facility.

(3)

Vehicles used for the collection and transportation of garbage, rubbish, or refuse using traditionally used routes. "Traditionally used routes" are any streets used for a period of one year or more as access to or from a solid waste disposal site as defined in California Vehicle Code Section 35701 (e).

(4)

An interstate truck on a route designated by the city when traveling to or from an interstate truck terminal.
