Chapter 73 — BICYCLES

§ 73.01 DEFINITIONS. ¶
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BICYCLE. Any device upon which a person may ride, which is propelled by human power through a system of belts, chains, or gears having either two or three wheels (one of which is at least 20 inches in diameter) or having a frame size of at least 14 inches, or having four or more wheels.

DOWNTOWN AREA. That territory:
(1) Bounded on the south by the south line of Seventh Street;
(2) Bounded on the east by the east line of J Street;
(3) Bounded on the west by the west line of A Street;
(4) Bounded on the north by the north city limits.

HENDERSON CENTER BUSINESS DISTRICT. That territory:
(1) Bounded on the north by a line parallel with Henderson Street and lying 120 feet northerly of the northerly line thereof;
(2) Bounded on the east by a line parallel with “F” Street and lying 120 feet easterly of the easterly line thereof;
(3) Bounded on the south by a line parallel with Harris Street and lying 180 feet southerly of the southerly line thereof;
- (4) Bounded on the west by a line parallel with “E” Street and lying 120 feet westerly of the westerly line thereof. ('63 Code, § 3-1.09)

§ 73.02 BICYCLE REGISTRATION REQUIRED. ¶
(A) Bicycles do not have sufficient identification numbers to properly safeguard or protect them from theft or to properly identify them when used in the perpetration of depredations and crimes, and it is necessary and essential and for the best interests of the city and the owners of such bicycles that each bicycle owned or operated in the city have suitable registration identification and that the use thereof be regulated so that this condition may be lessened or eliminated. (B) The owner or operator, if the owner does not live within the city, of every bicycle within the city shall register such bicycle with the Police Department, giving the name and address of the owner thereof, the name and address of the parents, or guardian if such owner shall be a minor, the make and type of the bicycle, and any and all other facts or information requested by the Chief of Police, and shall exhibit such bicycle to the Chief of Police, or any police officer authorized by the Chief of Police to inspect such bicycle, when required so to do. Application for such registration and identification, license plates, and certificate of registration shall be made on forms provided by the Police Department.

§ 73.03 CERTIFICATE OF REGISTRATION; LICENSE TAGS. ¶
(A) Upon application by such bicycle owner or operator being made, signed, and filed, a certificate of registration shall be issued, signed by the Chief of Police and delivered to the applicant, which certificate shall be in such form as prescribed by the Chief of Police. The Chief of Police shall also cause to be issued to such applicant a license tag, plate, or other means of identification which shall be immediately attached and affixed to the bicycle in such place and in such manner as may be designated by the Chief of Police, and such identification shall remain thereon at all times while such bicycle is owned or operated by the applicant.
(B) The applicant shall thereupon be permitted to operate such bicycle in the city, and it shall be unlawful to operate such bicycle within the city until the provisions of this section have been complied with.

§ 73.04 TRANSFER OF BICYCLE OWNERSHIP. ¶
Upon the sale, barter, exchange, pawning, or other hypothecation of such bicycle, the owner or operator thereof shall forthwith and immediately notify the Police Department, and the certificate of registration, license plate, or other means of identification shall be of no further force or effect. The purchaser or new owner, or the pawnbroker or person with whom such bicycle has been hypothecated, shall immediately make application to the Police Department for a new certificate of registration and license plate or other means of identification before the bicycle shall be operated in the city. § 73.05 BICYCLE DEALERS EXCEPTED. ¶
The provisions of this chapter shall not apply to any bona fide wholesale or retail dealer in bicycles; provided, however, such wholesale or retail dealer may, if he desires, apply for such license and receive such registration certificate and identification plate. § 73.06 RIDING BICYCLES ON SIDEWALKS. ¶
(A) No person shall ride a bicycle upon a sidewalk within the Henderson Center Business District or the Downtown Area.
(B) The provisions of this chapter do not apply to police officers in the course of their regular duties.

It is hereby determined upon the basis of an Engineering and Traffic Survey, that the speed permitted by state law upon the following streets is less than is necessary for the safe operation of vehicles thereon and it is hereby declared that the speed limit shall be as set forth in this section, on those streets or parts of streets designated when signs are erected giving notice thereof.
