Chapter 75 — MOBILE VENDORS OPERATING UPON A STREET

§ 75.01 AUTHORITY.

This chapter is adopted pursuant to the authority granted to the city by § 22455(b) of the California Vehicle Code, which permits local authorities to regulate the type of vending and the time, place and manner of vending from vehicles upon the street in order to promote public safety.

§ 75.02 DEFINITIONS.

For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

DOWNSTREAM. The direction that traffic moves as it travels away from an intersection on a one-way street. MOBILE VENDOR. Any vehicle from which a product is made, sold, or distributed at retail.

STREET. A way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. STREET includes HIGHWAY .

UPON A STREET. Legally parked adjacent to the curb.

VEHICLE. A device by which any person or property may be propelled or moved upon a highway, excepting a device moved exclusively by human power.

VEND or VENDING. To sell, offer for sale, display, barter, exchange, or otherwise provide a product from a vehicle. (Ord. 842-C.S., passed 7-19-16)

§ 75.03 REQUIRED CONDITIONS.

(A) Obstructions. A mobile vendor shall not obstruct pedestrian or vehicular traffic or block a driveway or alleyway.

(B) Intersections. A mobile vendor shall not operate within 50 feet of any street intersection (measured from the back of the nearest perpendicular sidewalk) unless on-street parking spaces are delineated, in which case the mobile vendor shall not operate within the two parking spaces located nearest to the corner. This restriction shall not apply on the downstream sides of one-way streets.

(C) Alleys. A mobile vendor shall not operate within 25 feet of an alley unless on-street parking spaces are delineated, in which case the mobile vendor shall not operate within the parking space located nearest to the alley. This restriction shall not apply on the downstream sides of one-way streets.

(D) Streets prohibited. A mobile vendor shall not operate on Fourth Street, Fifth Street, or Broadway.

(E) Schools. A mobile vendor shall not stand, stop, park, or operate within 300 feet of any property on which a K-12 school is located between the hours of 7:00 a.m. and 5:00 p.m. of any school day.

(F) Waste. Mobile vendors shall maintain a clearly designated waste receptacle in the immediate vicinity of the mobile vending sales while in operation.

(G) Vending side. Mobile vendors shall not distribute anything from the vehicle or operate in a manner that causes any person to stand in the street or parking lane.

(H) Utility connections. A mobile vendor shall not be connected to an external source of water, electricity, or sewer.

(I) Compliance with other laws and regulations. Mobile vendors shall obey all local, state, and federal laws.

(J) Business improvement districts. Mobile vendors which operate, or intend to operate, within a business improvement district shall pay associated fees.
