Chapter 119 — SECOND-HAND DEALERS

§ 119.01 LICENSE REQUIRED. ¶
Any person engaging in the business of dealing in second-hand radios, phonographs, electric irons, electric cooking equipment, electric motors, automobile accessories, cameras, bathtubs, patent toilets, musical instruments, sewing machines, washing machines, drag saws, gasoline motors, saddles, spurs, bicycles, clothing, tools, harnesses, ropes, whips, garden hose, firearms, diamonds, jewelry, silverware, old gold and silver, or either or any of such articles, either as merchant pawnbroker, or otherwise, shall make application to the Council for a license so to do. Such license may be granted by the City Clerk upon the payment of the license fee required and Council order by resolution. The City Clerk may thereafter from time to time renew such license upon the payment of the license fee; provided, however, the Council shall have the power to revoke such license upon good cause being shown.

§ 119.02 DEALERS' RECORDS AND REPORTS. ¶
(A) Records. The licensee shall keep a record of all such articles sold, purchased, pledged, or otherwise dealt in, which shall at all times during business hours be open to the inspection of the Chief of Police or any police officer. Such record shall contain a description of the article purchased, sold, pledged, or otherwise dealt in, the name and residence of the person from whom purchased or to whom sold, or by whom pledged, or with whom otherwise dealt, the age, sex, complexion, color of mustache or beard, style of dress, and height of such person, and the time when the articles were purchased, sold, pledged, or otherwise dealt in.

(B) Reports. The licensee shall at least once a day make and deliver to the Chief of Police, on a form to be furnished by the Chief of Police for that purpose, a full, true, and complete report of all dealings during the 24 hours preceding such report, together with the hour of the day when purchased, sold, pledged, or otherwise dealt in or with, and a description of the person from whom purchased, or to whom sold, or by whom pledged, or with whom dealt, and the true name, as nearly as the same is known to the person making such report. Such report shall be written in the English language in a clear, legible manner. ('63 Code, § 6-10.03)

§ 119.03 REPORT FORM; FILING OF REPORTS. ¶
(A) Report form. The Chief of Police shall cause report forms to be printed to provide for the following information:
(1) The name and residence of the person from whom purchased, to whom sold, by whom pledged, or with whom otherwise dealt;
(2) The age, sex, complexion, color of mustache or beard, style of dress, and height of such person;
(3) The time when the articles were purchased, sold, pledged, or otherwise dealt in;
(4) The date of the report;
- (5) The name and place of residence of the person making the report; and,
(6) The hour of the day when the report was made.

(B) Filing of reports. The Chief of Police shall deliver report forms to the licensees free of charge and shall, upon receipt of
such reports, file the same in his office. Such reports shall at all times be open to inspection only by the Police Department of the city and the peace officers of the county.

§ 119.04 MERCHANDISE TAGS. ¶
The licensee shall affix to each of the articles enumerated in § 119.01 of this chapter a tag upon which shall be inscribed a number, in legible characters, which number shall correspond to the number in the record book required to be kept as provided in § 119.02(A) of this chapter.
