Sec. 18-113. - Loudspeakers, etc.—Operation.¶
Except as provided in section 18-114, it shall be unlawful for any person to operate or play a radio, jukebox or other mechanical phonograph instrument or to use or operate a loudspeaker or other sound-amplifying equipment on the streets, sidewalks, alleys, parks, parkways, public buildings and public places in the city in such manner that loud or unusual noises are produced, which noises are offensive, disturbing or which interfere with the comfortable enjoyment of life or property or the business of the inhabitants of the neighborhood where such noises are produced.

Sec. 18-114. - Same—Permit prerequisite to transportation.¶
It shall be unlawful for any person to transport any radio, loudspeaker, mechanical phonograph instrument or other sound-amplifying equipment while the same is playing and producing any loud noise, words or music upon the streets or sidewalks of the city without first having procured a permit so to do from the chief of police or from the city council, upon such terms and conditions as the chief of police or council may fix.

Sec. 18-115. - Definitions.¶
When used in this division, the following words and phrases shall have the following meanings:
City street or highway means all public streets or highways within the city.
Median means that portion of any city street or highway, which is either raised and/or painted, and which separates lanes of traffic on that street or highway.

Sec. 18-116. - Unlawful occupation of center medians prohibited.¶
No person shall stand or sit upon, or otherwise occupy or use a center median for any purpose other than to do so temporarily while lawfully crossing any city street or highway.

Sec. 18-117. - Violations.¶
Any person violating or failing to comply with any provision of this division or failing to comply with any of its requirements shall be deemed guilty of an infraction.
Upon a conviction thereof, the violator shall be punished by a fine not exceeding one hundred dollars ($100.00) for a first violation; a fine not exceeding two hundred dollars ($200.00) for a second violation within one (1) year; and a fine not exceeding five hundred dollars ($500.00) for each additional violation within one (1) year.
Alternatively, any violation of the provisions of this division shall constitute a public nuisance and may be abated by the city attorney through civil process by means of a restraining order, preliminary or permanent injunction, or any other manner provided by law for the abatement of such nuisance.
