Sec. 11-26. - Required.

It shall be unlawful for any person to establish, maintain or operate a food establishment unless he shall have secured a permit therefor from the health officer.

Sec. 11-27. - Fee.

An annual permit fee of five dollars ($5.00), payable in advance, shall be paid by the holder of a permit as referred to in section 11-26.

Sec. 11-28. - Investigation of premises; issuance.

Upon the filing of an application for a permit as required in section 11-26, the health officer shall inspect the premises and operations of the applicant. If such applicant shall have fully complied with the provisions of all state laws and of this Code and other ordinances of the city with reference to plumbing, water supply, housing and sanitation, the health officer shall issue to each applicant a written or required permit for such establishment.

Sec. 11-29. - Council to designate inspection score necessary to obtain or maintain…

The city council by resolution shall designate the score which any establishment must maintain, and no permit required by this division shall be issued to any establishment maintaining a score less than that so designated by the city council and shown on the score card approved and adopted by the city council. If, upon inspection any establishment shall fail to meet this standard, due written notice shall be served upon the person owning, controlling, operating or maintaining the establishment that such corrections as are necessary shall be made within thirty (30) days, or less, at which time a reinspection shall be made. Failure to comply with such written notice shall be deemed sufficient cause for suspension or revocation of the permit.

Sec. 11-30. - Posting of permit or grade card.

Every health permit or alphabetical grade card issued shall be kept posted in a conspicuous place in the establishment for which the permit is issued under the provisions of this division. The health officer shall prescribe the size and the location in or on the establishment where such permit or grade card shall be kept posted. Failure to have a grade card posted while the food establishment is operating is a misdemeanor and shall be due cause for immediate suspension or revocation of the health permit. Such alphabetical grade card shall not be camouflaged, defaced or otherwise hidden so as to prevent the public from observing the sanitation grade of the health regulated business.

Sec. 11-31. - Transfer.

A permit issued under the provisions of section 11-28 shall not be transferable.

Sec. 11-32. - Revocation and suspension.

A permit issued pursuant to section 11-28 may be revoked or suspended by the health officer for the violation of any of the provisions of this chapter or the failure to comply with any state law or ordinance relative to food establishments or food handlers or rule or regulation of the health officer; provided, however, that the permittee, within twenty-four (24) hours after serving of notice of suspension or revocation upon the food establishment, may in writing request a hearing upon the matter of suspension or revocation. If such hearing is requested within such time, the health officer shall conduct a hearing within five (5) days after receipt of such request, and shall give notice of the time and place where such hearing will be held. At or after such hearing, the health officer may, if he deems it in the public interest and welfare, withdraw his suspension or revocation and provide conditions upon which such permit will be reissued or restored.

Sec. 11-33. - Term.

All permits issued under the provisions of section 11-28 shall be valid for a period of one year from the date thereof unless the same is sooner suspended or revoked or unless the permittee changes the position of his place of business or sells or otherwise disposes of such business.
