5.84.010 - Definition.¶
Non-Chartered Financial Institution. A use, other than state or federally chartered bank, credit union, mortgage lender or savings and loan association, that offers deferred deposit transaction services or check cashing services and loans for payment of a percentage fee. Specifically included in the term "non-chartered financial institutions" are deferred deposit transaction (payday loan) businesses that make loans upon assignment of wages received, check cashing businesses that charge a percentage fee for cashing a check or negotiable instrument, and motor vehicle title lenders who offer a short-term loan secured by the title to a motor vehicle. Non-profit financial institutions are not encompassed by the term non-chartered financial institution.

5.84.020 - Hours of operation.¶
The hours of operation of any non-chartered financial institution shall be restricted to between the hours of 7:00 a.m. and 7:00 p.m.

5.84.030 - Operational requirements.¶
In addition to any other requirements imposed through the Zoning Ordinance, any non-chartered financial institution shall provide both a security plan and a lighting plan. The plans must be approved by the city prior to operation and adhered to by the business.

5.84.040 - Violation—Penalty.¶
A. Any person found to be in violation of any provision of this chapter shall be subject to the enforcement remedies set forth in Title 1, at the discretion of the city, including, but not limited to, prosecution as a misdemeanor violation punishable as set forth in Chapter 1.12.
B. Each violation of this chapter and each day of violation of this chapter shall be considered as separate and distinct violations thereof and the imposition of a penalty shall be as set forth in subsection A of this section for each and every separate violation and each and every day of violation.

5.84.050 - Public nuisance.¶
Any use or condition caused or permitted to exist in violation of any of the provisions of this chapter shall be and is hereby declared a public nuisance and may be abated by the city pursuant to the procedures set forth in Chapter 8.08.

5.84.060 - Severability.¶
If any section, subsection, subdivision, paragraph, sentence, clause, or phrase in this chapter or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this chapter or any part thereof. The city council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof irrespective of the fact that any one or more subsections, subdivisions, paragraphs, sentences, clauses, or phrases be declared unconstitutional, or invalid, or ineffective.
