Duarte Municipal Code Ch. 6.22 Restaurant and Food Establishments

Ordinance No. 97-0071 of the county of Los Angeles, effective January 16, 1998, a copy of which shall remain on file in the office of the city clerk for use and examination by the public, is adopted and incorporated herein by reference as if fully set forth.

For the purposes of interpreting the provisions incorporated into this code pursuant to Section 6.22.010, the following provisions of the county of Los Angeles code are adopted and incorporated herein by reference as if fully set forth:

(a) Part 1, Definitions, of Chapter 8.04, Public Health Licenses, of Title 11, Health and Safety.

(b) Article 2, Definitions, of Part 1, General Provisions, of Chapter 11.02, General Provisions and Definitions, of Title 11, Health and Safety.

(c) Article 2, Definitions, of Part 2, Provisions for Chapters 11.06 through 11.38, of Chapter 11.02, General Provisions and Definitions, of Title 11, Health and Safety.

In addition to such remedies for violations of Ordinance No. 97-0071 of the county of Los Angeles as may be set forth therein, a violation of this chapter shall constitute a violation of this code and the remedies set forth in this code shall be available for such violation, including, but not limited to, that a violation of this chapter shall constitute public nuisance, may be enforced by criminal penalties set forth in this code, and may be enforced by civil action including an action for injunctive relief. The city may recover its legal costs, including but not limited to its attorneys' fees, in any action to enforce provisions of this chapter.

In the event of any conflict, ambiguity, or inconsistency between the provisions of Ordinance No. 97-0071 of the county of Los Angeles incorporated herein pursuant to Section 6.22.010 or the provisions of those portions of the code of the county of Los Angeles incorporated herein pursuant to Section 6.22.020 on the one hand, and any additions thereto or amendments thereof as set forth in this chapter on the other hand, any such additions thereto or amendments thereof as set forth in this chapter shall control. In the event of any conflict, ambiguity, or inconsistency between the provisions of Ordinance No. 97-0071 of the county of Los Angeles incorporated herein pursuant to Section 6.22.010 or the provisions of those portions of the code of the county of Los Angeles incorporated herein pursuant to Section 6.22.020 on the one hand, and any other provisions of the Duarte Municipal Code on the other hand, such other provisions of the Duarte Municipal Code shall control.
