6.13.010 - County code adopted by reference.¶
Except as herein provided, County of Los Angeles Ordinance No. 2018-0037, known as the Local Agency Management Program (LAMP), as contained in Title 8 (Consumer Protection, Business and Wage Regulations) and Title 11 (Health and Safety) of the Los Angeles County Code is hereby incorporated by reference as adopted by Ordinance No. 25-01, adopted March 25, 2025, and shall regulate conventional and non-conventional onsite wastewater treatment systems (OWTS) within the city of Duarte, including review, siting, permitting and operational requirements for OWTS, and providing for collections of fees associated with the monitoring and enforcement of OWTS.

6.13.020 - Fees.¶
The city may establish any fees for services provided in this chapter that do not conflict with the Memorandum of Understanding between the city of Duarte and the county of Los Angeles Department of Public Health regarding onsite wastewaster treatment systems.

6.13.030 - Violation.¶
In addition to such remedies for violations of Ordinance No. 2018-0037 of the county of Los Angeles as may be set forth therein, a violation of this chapter shall constitute a violation of the Duarte Municipal and/or Duarte Development Codes and the remedies set forth in those codes shall be available for such violation, including, but not limited to, that a violation of this chapter shall constitute public nuisance, may be enforced by criminal penalties set forth in this code, and may be enforced by civil action including an action for injunctive relief. The city may recover its legal costs, including but not limited to its attorneys' fees, in any action to enforce provisions of this chapter.
