6.10.010 - Definitions.

The term "carnival," as used in this chapter, means and includes amusements, activities, rides, merry-go-rounds, booths for the conduct of games of skill, food dispensing facilities and sideshows. A carnival shall not include gambling devices, games of chance, lotteries, punch boards or other activities in violation of city ordinances.

6.10.020 - License—Required.

It is unlawful to conduct or operate within the city any carnival which is open to the public without first securing a license therefor; provided, that this Section shall not be held to apply to those amusements or exhibitions which are specifically licensed in other sections of this Code.

6.10.030 - License—Conditions.

In addition to other requirements set forth in this chapter, the applicant shall furnish suitable evidence of its intention and ability to comply with the following conditions:

A. No ride shall be placed in operation until the same is free from mechanical, structural, electrical and other hazards.

B. Adequate safeguards shall be placed to protect both operators and the general public from inadvertently coming into contact with moving parts, belts, motor gears, electrical switches and other possible or potential hazards.

6.10.040 - Insurance prerequisite.

No license shall be issued for conducting a carnival until the applicant therefor has placed on file with the city clerk a certificate or certificates of insurance indicating that there is in effect public liability insurance covering any damages arising out of the use and operation of any and all devices and facilities operated in connection with such carnival. Such insurance shall be in the minimum amount of two hundred fifty thousand dollars for each person and five hundred thousand dollars for each accident.

Such public liability insurance shall be maintained to indemnify the city against any and all claims, demands or injuries arising from the conduct or management of, or from any work or thing whatsoever arising during such carnival activity, however caused, to any person or persons or to the property of any person or persons occurring during the conduct of such carnival, against all costs, attorney fees, expenses and liabilities incurred in connection with any such claim or proceeding or action brought thereon.

6.10.050 - License—Issuance—Fees.

Upon satisfactory application being made and approved by the city finance director and the city manager, the city treasurer shall issue such license. The following schedule of fee shall apply to such license: the sum of two hundred fifty dollars per day for each day of operation.

6.10.060 - Compliance with federal, state and city requirements required.

There shall be no limit to the number of rides or sideshows or other exhibitions connected therewith, save and except that each ride and exhibition shall comply with any and all federal, state or city ordinances governing the conduct and safety thereof and the space to be occupied thereby and the manner in which it is to be conducted for the safety, comfort and welfare of the public.

6.10.070 - Licensee to be charitable.

No license shall be issued except to a charitable social or fraternal organization within the city.
