2.39.010 - Definitions.¶
Unless other stated:
A. "Airport manager" means the appointed manager of the Delano Municipal Airport, or his duly authorized representative.
B. "Commercial venture, purpose or operation" means the use of the airport by any person, group, club, association, or corporation as a base for the carrying on of commercial activities for the carrying for hire of passengers, freight, express or mail for instruction in aviation in any of its branches, for the sale of fuels, refreshments or any commodity, for aircraft rental or sales, or for any other commercial purpose.
C. "Field privileges" means to make use of the airport for takeoff, landing, taxiing, parking and tie-down.
D. "Gross weight" means the maximum allowable gross weight of such aircraft as determined by the Federal Aviation Agency and incorporated in the certificate of airworthiness of the particular aircraft.
E. "Local aircraft" means an aircraft that has on file a complete standard form of registration for permanent storage with the airport manager.
F. "Municipal airport" means the airport which is owned and operated by the City of Delano.
G. "Transient aircraft" means an aircraft not qualified as a local aircraft.

2.39.020 - Rules of conduct.¶
A. No person shall destroy, injure, deface or disturb in any way any building, sign, equipment, marker, shrub, tree, flower, lawn, or other property on the airport without written permission of the airport manager.
B. No person shall commit any obscene, disorderly, indecent, or unlawful act, or commit any nuisance on the airport.
C. No person shall abandon any personal property on the airport.
D. No hunting is allowed at any time within the airport boundaries.

2.39.030 - Restricted areas.¶
No person shall enter any restricted area posted as being closed to the public, except:
A. Persons assigned to duty thereon;
B. Persons authorized by the airport manager;
C. Persons under appropriate supervision entering the apron for the purposes of enplaning and deplaning.

2.39.040 - Conduct of business.¶
No person shall engage in any business or commercial activity of any nature on the airport except in conformance with an appropriate authorization and under such terms and conditions as may be prescribed therein by the airport manager and/or city council.

2.39.050 - Soliciting.¶
No person shall solicit for any purpose on the airport without permission of the airport manager.

2.39.060 - Advertisements.¶
No person shall post, distribute, or display signs, advertisements, circulars, printed or written matter at the airport except with the approval and in such a manner as may be prescribed by the airport manager.

2.39.070 - Firearms.¶
A. No persons, except designated peace officers, shall carry any firearms, including air-guns, explosives, bows and arrows, or flammable materials on the airport without the written permission of the airport manager. Such permission may be granted by the airport manager when circumstances warrant.
B. All other persons shall immediately surrender all such objects in their possession to the airport manager.

2.39.080 - Animals.¶
Animals shall not be permitted on the airport unless leashed or restrained in such a manner as to be under control.

2.39.090 - Use of roads and walks.¶
No person shall use the roads, walks, landing areas, or restricted areas in such a manner as to hinder or obstruct their proper use without first obtaining permission from the airport manager.

2.39.100 - Land transportation.¶
A. Vehicles shall not be parked on the airport other than in the manner and at locations indicated in designated areas.
B. No common-carrier vehicle or vehicle for hire shall load or unload passengers or stand at the airport at any place other than in the area designated by the airport manager.
C. Motorized equipment shall not be operated on the apron except by persons assigned to duty thereon or others authorized by the airport manager.
D. No person shall operate any vehicle on any of the landing areas unless authorized to do so by the airport manager, and then only in such a manner as may be prescribed.
E. Motor vehicles shall be operated in strict compliance with speed limits prescribed by the airport manager and indicated by posted traffic signs. The speed limit in unposted areas will be five miles per hour. The airport manager shall have the authority to move vehicles parked in such places and in such manner as to hinder any approved operation. Said authority shall include the authority to tow away the vehicle at the owner's expense.
F. Vehicles or equipment operated or parked within or on any taxiway or runway area shall be marked with an approved obstruction flag and/or light.
G. Any vehicle-authorized access to the east side of the airport shall not cross the main runway except at the northernmost end.

2.39.110 - Fire hazards.¶
A. No activity, including but not limited to painting, doping, and cleaning, shall be conducted on airport property with any flammable substances having a flash point below two hundred degrees Fahrenheit unless the activity and the manner in which it is to be conducted have been approved in writing by the airport manager.
B. Smoking and open fires shall be prohibited in all areas designated and/or posted by the airport manager.
C. No person shall keep, store, or discard any flammable liquids, gases, signal flares, oily rags, or other combustible material in the hangars or in any buildings on the airport without the prior written approval of the airport manager concerning the location and manner of conducting such storage or disposal operations.
D. No person shall dump any waste, refuse, or other material on the airport.
E. Hangar entrances shall be kept clear at all times for ingress and egress of tenants' aircraft. No person shall use flammable liquids in the cleaning of aircraft, aircraft engines, propellers and appliances without the prior written approval of the airport manager concerning the location and manner of conducting such cleaning operations.
F. All lessees on the airport shall keep their hangars and areas adjacent thereto leased or used by them respectively free and clear of waste material, rubbish and other flammable material.

2.39.120 - Fueling operations.¶
A. No aircraft shall be fueled or drained while the engine is running or while such aircraft is in a hangar or enclosed space.
B. No smoking shall be permitted within one hundred feet of any aircraft being fueled or defueled.
C. No person shall operate any radio transmitter or receiver or switch electrical appliances off or on in or within fifty feet of an aircraft during fueling or defueling.
D. During fueling, the aircraft and the fuel dispensing apparatus shall be properly grounded.
E. Persons engaged in the fueling or defueling of aircraft shall exercise due care. All fuel spills will be cleared from area before aircraft are started or left unattended.
F. Adequate fire extinguishers shall be available in the immediate area (within twenty feet) of all fueling and defueling operations.
G. No person shall start the engine of any aircraft when there is any gasoline on the ground within one hundred feet of the aircraft.
H. Fueling hoses and defueling equipment shall be maintained and operated in a safe and sound condition and shall be equipped with a grounding device to prevent ignition of volatile liquids.
I. Aviation fuels and/or lubricants shall not be sold or dispensed into any aircraft or other containers on the airport except in such a manner and under such terms and conditions as may be prescribed by the airport manager.

2.39.130 - Air rules.¶
A. Traffic pattern altitude is eight hundred feet AGL for piston engine aircraft below twelve thousand five hundred pounds gross weight. For turbine-powered aircraft, and all aircraft above twelve thousand five hundred pounds gross weight, the traffic pattern altitude is fifteen hundred feet AGL.
B. Runway 32 has been designated as the "Calm Wind" runway and will be used when the wind velocity is below five knots.
C. Takeoff from the first intersection of Runway 32 is allowed at the pilot's discretion. No other intersection takeoffs will be permitted.
D. All crop-dusting aircraft shall use the east auxiliary runway by first obtaining permission of the airport manager.
E. General aviation aircraft may only use the east auxiliary runway by first obtaining permission of the airport manager.
F. No aeronautical activity shall be conducted at the airport except in conformance with the State Aeronautics Act and applicable federal air regulations.
G. No aircraft shall be taxied except at a safe and reasonable speed and in no case in excess of fifteen miles per hour. No aircraft shall take off or land, emergency landings excepted, from any area except the state approved runways.
H. Aircraft shall not cross any runway until the pilot has stopped and made certain by visual inspection that there is no danger of collision with any person or object.
I. Taxiing into and out of hangars is specifically prohibited.
J. Except in an emergency, no turn shall be made after takeoff until the airport boundary has been reached and the pilot has attained an altitude of at least four hundred feet and has ascertained that there will be no danger of turning into the path of a following aircraft.
K. Aircraft leaving the pattern shall make a forty-five degree turn away from the airport. Aircraft landing straight in shall not interfere with any aircraft in the traffic pattern.
L. Aircraft entering the pattern shall enter at a forty-five degree angle to the downwind leg.
M. Engines must be stopped while passengers are being enplaned or deplaned.
N. No aircraft shall remain on the landing or takeoff area longer than necessary to safely land or take off.

2.39.140 - General conduct of operators and owners.¶
A. Payment or satisfactory credit arrangements must be made for storage, repairs, supplies, or services rendered by the airport before flight clearance may be granted, or before the aircraft may be moved or relocated on or off the airport.
B. Aircraft owners, their pilots, or agents shall be responsible for the prompt removal of disabled aircraft and parts thereof. The airport manager and/or state and federal aviation authorities may delay such action pending investigation of an accident.
C. Any and all airport property destroyed, injured, or damaged by accident or otherwise shall be paid for by the party or parties responsible for such destruction, injury, or damage thereto.
D. Aircraft engines shall not be started or run unless a properly certificated pilot or mechanic is at the controls. The aircraft must be equipped with adequate brakes, fully applied, or the wheels must be securely blocked with chocks which can be removed safely, or the aircraft shall be securely tied down.
E. Persons involved in accidents on the airport shall make a full report thereon to the airport manager as soon after the accident as possible, and to state and federal aviation authorities as required.
F. No aircraft shall be left unattended on the airport unless properly secured or in a hangar. Owners of aircraft not properly secured shall be held responsible for all damage resulting from the failure to comply with this rule and all expenses incurred by the airport management to properly secure such aircraft when such action is deemed necessary by the airport manager.
G. The monthly rates shall be determined on a calendar month basis and will apply when the total charge at the daily rate equals or exceeds the monthly rate.
H. There shall be no assignment of rental agreements or subletting of any of the property, or any part thereof, without first having obtained the written consent of the airport manager.

2.39.150 - Insurance.¶
A. All commercial operators on the airport operated by the city will obtain public liability and property damage insurance with a hold-harmless agreement in favor of the city, its officers and employees in the following amounts:

single limit per occurrence for bodily injury, personal injury and property damage. If commercial general liability insurance or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to this location or the general aggregate limit shall be twice the required occurrence limit.
B. Certificates of insurance will be filed with the airport manager. Thirty days' prior notice of cancellation shall also be filed with the airport manager.

2.39.160 - Assumption of liability denied.¶
The city, its agents or employees operating the airport, assumes no responsibility for damage to property stored thereon or property thereon of persons using the airport facilities, by reason of fire, removal of disabled aircraft, theft, vandalism, windstorm, flood, earthquake, and/or collision, nor does it assume any liability by reason of injury to persons while on the airport or while using the facilities of same.

2.39.170 - Rates and charges.¶
The rates and charges for the use of land and facilities of the Delano Municipal Airport shall be those established from time to time by resolution of the city council.

2.39.180 - Violation—Penalty.¶
A. Any person operating or handling any aircraft, vehicle, equipment or apparatus, or using the airport or any of its facilities in violation of the rules and regulations that may be prescribed, or refusing to comply therewith, may be promptly removed from the airport; moreover, for cause, any person might be deprived of and refused the further use of the airport and its facilities by the airport manager upon the order of his superior authority on his own initiative for such length of time as may be required to insure the safeguarding of the airport and the public and its interest therein. The airport manager shall exercise discretion in this matter. If unnecessary hardship results, appeal may be made to the city council.
B. Any person, firm, or corporation who violates or refuses to abide by any of the provisions of this chapter, or any of the rules and regulations set forth in any section of this chapter or any of the rules and regulations set forth in any section of this chapter or any of the provisions of law incorporated herein, is guilty of a misdemeanor, and upon conviction thereof shall be punishable as provided in Chapter 1.16.
