Notes

Under Sections 65100—65512 of the Government Code, there is created the Planning Agency of the Town consisting of the following component members:

• a. Town Council.

• b. Planning Commission.

• c. Planning Department.

• d. Such other components as the Town Council may create.

a. Recommend for adoption by the Town Council a comprehensive long term general plan for the physical development of the Town;

b. Recommend for adoption by the Town Council specific plans based on the general plan and drafts of such regulation, programs and legislation as may in its judgment be required for the systematic execution of the general plan;

• c. Periodically review the capital improvement program of the Town;

• d. Recommend a zoning ordinance for adoption by the Town Council;

e. Recommend to the Town Council the approval, disapproval or modification of all maps or plats of land subdivision in accordance with the Subdivision Map Act;

f. Perform other duties regarding planning, zoning and State law matters prescribed by the Town Council.

a. The Town Manager appoints the Planning Director on the basis of qualification with the approval of the Town Council. In the absence or disability of the Planning Director, the Town Manager shall designate a person to perform the duties and exercise the powers of the Planning Director. The Planning Director is subject to the Town Manager’s general administrative direction.

b. The Planning Director manages the Planning Department. Subject to the Town Manager’s approval, the Planning Director may organize and maintain such diversions in the department as in his judgment the operations require. The Planning Director is responsible for the direction and control of functions assigned to the department.

The Planning Director has the following duties:

a. Provides staff assistance to the Town Council, Town Manager, and Planning Commission;

b. Serve as Secretary to the Planning Commission, or designate an assistant to serve as the Secretary. Before the appointment of the first Planning Director or in the absence of the Planning Director or his designee, the Town Manager shall designate a person to act as Secretary;

c. Make surveys, gather data, prepare reports, maps, charts and graphic presentation, adoption and revision of the general plan;

• d. Enforce the planning and zoning laws of the State and ordinances of the Town;

e. Conduct the Town’s environmental review process in accordance with the State Environmental Quality Act and generally be responsible for environmental matters;

• f. Manage and coordinate all matters concerning housing and commercial buildings; and

g. Hear and decide applications as may be authorized by ordinance or elsewhere in this chapter or the Land Development Chapter.

A final decision of the Planning Commission may be appealed to the Town Council. (Ord. #13, §8-105)
