2-7.1 Creation of Planning Commission. ¶
A Planning Commission of the Town of Danville is hereby established. The Planning Commission consists of seven (7) regular members appointed by the Town Council and one (1) or two (2) alternate members that may be appointed by the Town Council at its discretion. (Ord. #13, §3-101; Ord. #95-2, §2)
2-7.2 Term of Office. ¶
The term of office of each regular member is four (4) years unless otherwise determined by the Council. Each regular member shall serve until their successor is appointed and qualified. The term of office of any alternate members shall be for terms so designated by the Council at the time of their appointment. (Ord. #13, §3-102; Ord. #33-84, §§1, 3-102; Ord. #953, §2)
2-7.3 Removal or Vacancy. ¶
A member of the Commission may be removed by a majority vote of the Council. A vacancy is filled in the same manner as the original appointment. A person appointed to fill a vacancy serves for the remainder of the unexpired term. (Ord. #13, §3-103)
2-7.4 Absence from Meeting. ¶
If a member of the Commission is absent without cause from three (3) successive regular meetings of the Commission, the office becomes a vacant automatically. The Commission shall immediately notify the Town Council of the vacancy.
A member is not absent without cause if absence is (1) due to illness or (2) unavoidable and the member gives the Secretary of the Commission written notice before the day of the meeting of absence and giving the reason for the absence. (Ord. #13, §3-104)
2-7.5 Time and Place of Regular Meeting. ¶
The Commission shall meet on the second and fourth Tuesdays of the month at the hour of 7:30 p.m. at the Town Meeting Hall located at 201 Front Street, Danville. Changes to the location, date and time for the regular Planning Commission meetings shall be approved by resolution of the Town Council after a thirty (30) day public notice period. 2-7.6 No Compensation. ¶
Members of the Planning Commission do not receive compensation for attendance at Commission meetings, but are entitled to reimbursement for expenses incurred in the course of their duties upon approval by the Town Council. (Ord. #13, §3-106)
2-7.7 Election of Chair, Vice-Chair and Secretary; Term. ¶
The Commission shall elect a Chair and Vice-Chair from among its members. The Chair and Vice-Chair serve for a term of one year and until the successor of each is appointed and qualified. A secretary shall be provided for pursuant to subsection 2-8.4, paragraph b. (Ord. #13, §3-107)
2-7.8 Adoption of Rules. ¶
The Commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings and determinations. (Ord. #13, §3-108)
2-7.9 Quorum. ¶
Four (4) members of the Commission constitute a quorum for the transaction of business. (Ord. #13, §3-109)
2-7.10 Duties of Officers of the Commission. ¶
a. Chair . The Chair shall preside at all meetings of the Commission. The Chair shall appoint all committees and shall perform all the duties necessary or incidental to the office.
b. Vice-Chair . The Vice-Chair is Chair in the absence or inability of the Chair to act.
c. Secretary . The Secretary shall keep minutes of each meeting and shall record each hearing and official action. (Ord. #13, §3-110)
2-7.11 Planning Commission Alternates. ¶
The Town Council may at its discretion appoint one (1) or two (2) Planning Commission Alternates who shall serve for terms so designated by the Town Council at the time of their appointment. The alternate member or members of the Commission shall attend all regular and special meetings of the Commission. If a regular member of the Commission is absent for any reason from all or any part of a regular or special meeting of the Commission, an alternate member shall participate in such meeting during the period of absence. During such participation, the alternate member shall receive and exercise all rights and privileges of a regular member, including the right to vote on matters before the Commission. The Commission shall adopt such rules as are necessary and desirable to effectuate the purposes of this section. (Ord. #95-2, §3)
2-7.12 Residency Requirement. ¶
All members of the Commission and any alternates shall be residents of the Town of Danville. (Ord. #95-3, §3)
