2-6.1 Established.

There is established in the government of the City of Clearlake the office of Director of Finance. (Ord. #19, S1)

2-6.2 Duties.

The Director of Finance has the following duties and responsibilities: a. To maintain and operate the general accounting system of the City and of each of the respective departments, divisions and services of the City; b. To perform such accounting functions and duties in accordance with such accounting methods as the state of the art and needs of the City shall indicate;

c. To maintain, or to prescribe and require the maintaining of inventory records of municipal properties in accordance with generally accepted municipal accounting practices; d. To perform the functions and duties relating to the administration and collection of taxes, licenses and permit fees levied by the City; e. To perform the duties relating to preparing, auditing, presenting, and disbursing claims and demands against the City, including payroll; f. To assist in the purchase of supplies, goods, wares, merchandise, equipment and materials required by the City; g. To assist in the preparation of the annual budget and in the administration of the budget; and h. To cooperate with the City Treasurer, the City Manager and other officials of the City in establishing and maintaining sufficient and satisfactory procedures and controls over municipal revenues and expenditures in all departments, divisions and services of the City in accordance with generally accepted municipal accounting practice. 2-6.3 Preparation and Presentation of Financial Reports.

The Director of Finance shall prepare and present to the City Council in sufficient detail to show the exact financial condition of the City, the following reports: a. A quarterly or more frequently as requested, statement of all receipts, disbursements and balance of the City; b. An annual statement of report of the financial condition of the City; c. Such other financial reports as the City Council or City Manager shall direct. (Ord. #19, S3; Ord. #2012-153)

2-6.4 Additional Duties.

The Director of Finance shall perform other additional duties and functions which the City Council or City Manager prescribes. (Ord. #19, S4; Ord. #2012-153)

2-6.5 Certain Duties of City Clerk to Be Duties of Director of Finance.

Pursuant to Section 2-5, the Office of Director of Finance is separate from the Office of City Clerk, and the duties imposed upon the City Clerk by Government Code Sections 37201 through 37208 inclusive, and the financial and accounting duties imposed upon the City Clerk by Sections 40802 through 40805 of the Government Code are declared to be duties of the Director of Finance in accordance with Sections 40805.5 and 37209 of the Government Code. (Ord. #19, S5) 2-6.6 Appointment by City Manager; City Clerk to Serve in Absence of Appointment. The Director of Finance is appointed by the City Manager and serves at the pleasure of the City Manager. In the absence of an appointment by the City Manager the City Clerk serves as the Director of Finance; however, the performance of such duties by the City Clerk shall not act to consolidate the offices of City Clerk and Director of Finance, and it is intended by the City Council that the two offices shall remain separate and be compensated separately, even though the same person may hold both offices simultaneously. 2-6.7 Appointment of Deputies; Consent of City Manager.

With the consent of the City Manager, the Director of Finance may appoint one or more Deputy Directors of Finance. Each Deputy Director shall perform the duties prescribed by the Director and the City Manager. (Ord. #19, S7; Ord. #2012-153)

2-6.8 Bond Required.

When the Director enters upon his or her duties, he or she shall execute a bond to the City required by Sections 37209 and 36518 of the Government Code. The bond shall conform to the provisions of the Government Code relating to bonds for public officers. The penal sum of the bond shall be established by resolution of the City Council on recommendation of the City Attorney. (Ord. #19, S8; Ord. #46, S1)
