2.12.010 - Establishment of Planning Commission.

A planning commission is hereby established.

2.12.020 - Membership.

The Planning Commission shall consist of five (5) members appointed by the Mayor with the approval of the City Council. No Commissioner will serve more than eight (8) consecutive years effective as of January 1, 1988. All members shall be qualified electors of the city.

2.12.025 - Monthly Compensation.

Each member of the Planning Commission shall receive compensation in the amount of one hundred and twenty dollars ($120.00) per month for each full month of the Commission Member's term of office, provided however, no compensation shall be paid for any month in which the Commission fails to hold at least one regular public meeting.

2.12.030 - Election of Officers—Adoption of Rules of Business—Public Record.

The Planning Commission shall elect its chair and vice chair from among its appointed members for a term of one year with no member to serve consecutive terms as chair. The Community Development Director shall serve as Secretary to the Commission. The Commission shall adopt rules for the transaction of business. The Community Development Director shall keep a public record of the Commission's determinations.

2.12.040 - Term of Office.

The term of office for each member appointed to the Planning Commission shall be two (2) years, unless a member is appointed to fill a vacancy in accordance with Section 2.12.060.

2.12.050 - Duties.

The planning commission shall perform the duties and shall have all the rights, powers and privileges specified and provided by state law or by city ordinance or resolution.

2.12.060 - Removal from Office—Filling of Vacancies.

Any member of the Commission may be removed from the Commission prior to the expiration of his or her term by either the Mayor, subject to the approval of the City Council, or by a majority vote of the City Council. The Mayor with the approval of the City Council for the unexpired term shall fill vacancies on the Commission from whatever cause.

2.12.070 - Absence.

A. If a member of the Commission is absent from three (3) consecutive meetings of the Commission of which the Commissioners have received at least twenty-four (24) hours prior written notice of such meeting, without cause, the office of such member may be deemed to be vacant and the term of such member terminated by the City Council; the Commission shall immediately inform the City Council of such absences and the City Council shall then determine if termination of the Commissioner's term of office is warranted.

B. An absence due to illness or an unavoidable absence from the city with notice thereof to the Commission on or before the day of the meeting from which the member is to be absent shall be deemed to be absence for cause.

2.12.080 - Meetings—Regular.

The regular meetings of the Commission shall be held on the second and fourth Tuesdays of each and every month beginning at a time and place within the city as established by resolution of the Commission. Whenever the Tuesday set for a regular meeting shall be a legal holiday, then said meeting shall be held on the next following day at the same time and place.

2.12.090 - Meetings—Special.

Special meetings of the Commission may be called at any time by the chair or by any three (3) or more members of the Commission upon personal notice being given to all members of the Commission. If personal notice cannot be given, written notice must be mailed or transmitted via facsimile to such members at least twenty-four (24) hours prior to the meeting, unless the notice requirement is waived in writing by that member.
