Sec. 18-546. - Appeal.

An applicant may file an appeal of the determination made by the chief building official or the community development director of the fee. The applicant must file an appeal with the planning commission within ten days of the date the applicant is notified in writing of the fee. Such an appeal shall be heard by the planning commission, which may grant or deny the appeal. The appeal shall be applied for in the manner prescribed in, and be considered by the planning commission at a noticed public hearing governed by the city's zoning ordinance and shall be subject to the fee applicable to the appeal of the community development director's decision as established by resolution by the city council.

Sec. 18-547. - Application.

The application for an appeal shall include financial and other information that the community development director determines is necessary for staff to perform an independent evaluation of the applicant's rationale for the appeal and shall be a matter of public record.

Sec. 18-548. - Standards.

No appeal shall be granted to an applicant unless the planning commission finds in writing that the fee determined by the application of this article is not reasonably related to the need for specified low or very low income housing associated with the proposed nonresidential construction for the use type determined to be appropriate by the chief building official or the community development director in accord with this article.

Sec. 18-549. - Conditions and expiration.

The grant of the appeal may specify a reduced fee, a higher fee, no fee, and appropriate conditions applicable to such construction. Any appeal granted under this section shall expire upon the issuance of a building permit allowing conversion of the building or structure to another use or remodeling of the building or structure to permit additional employees.
