15.24.010 - Purpose of provisions—Swimming pool defined.

A. The purpose of this chapter is to set forth minimum health and safety standards in the construction of private swimming pools.

B. For the purpose of this chapter, "swimming pool" means a structure or container with a minimum surface area of one hundred seventy-five square feet and a depth of twenty-four inches or more used for wading or swimming.

15.24.020 - Filtration system required when.

A filtration system approved by the National Sanitation Foundation shall be required on all swimming pools having a capacity in excess of five thousand gallons of liquid.

15.24.030 - Enclosure and gate requirements.

All swimming pools, as defined in this chapter, shall be enclosed in a yard with a fence having a minimum height of five feet. All gates into said yard shall be of a self-closing design with an automatic latching device. The latching device shall be so placed or designed so that a child three feet six inches in height will be unable to operate it from the outside of the fenced area.

15.24.040 - Uniform Swimming Pool Code—Adopted.

A. There is adopted by reference by the city council for the purpose of providing minimum standards to safeguard life, health, property and public welfare by regulating and controlling the design, quality of materials, construction and location of all swimming pools within the city and that certain code identified as the Uniform Swimming Pool Code, published by the International Association of Plumbing and Mechanical Officials, save and except such portions as are hereinafter amended, deleted, or added to.

B. A copy of such code has been and is now on file in the community and economic development department.

15.24.050 - Building permit—Required.

No person, firm, or corporation shall construct any swimming pool in the city without first obtaining a building permit from the building inspector in accordance with the provisions of this chapter.

15.24.060 - Permit—Application.

The application for the permit required by this chapter shall be the same as used for building permits, and shall contain, among other things, the location of the proposed construction and the address or other identification of other property over which the contractor must move materials and equipment to gain access to the construction site.

15.24.070 - Permit—Issuance.

No person, except a property owner of the premises for which the application for the permit required in this chapter is being made, or a person licensed by the State Contractor's Licensing Board of a category permitting the construction of swimming pools, shall be issued a building permit for construction of a swimming pool.

15.24.080 - Permit issuance—Deposit for indemnification.

A building permit required by this chapter shall not be issued unless the applicant has deposited with the building inspector a cash bond, certified check, letter of credit or a security bond payable to the city in the sum of five hundred dollars to indemnify the city for any damage to improvements located within the city right-of-way used by contractors.

15.24.090 - Deposit for indemnification—Release.

The cash bond or any residual thereof required under this chapter may be released, upon certification by the building inspector that any city property damaged by the swimming pool contractor has been restored to as good a condition as it was prior to such damage or that city property suffered no damage incident to the construction process.

15.24.100 - Building inspector authority.

The building inspector shall have the right to inspect all trucks, tractors, excavators, and other equipment proposed to be used in the construction of swimming pools in the city. They shall be the sole judge as to the hazard of danger that such equipment may impose upon curbs, gutters, sidewalks and other improvements as may be located in the city right-of-way at or near the construction site, and they shall be vested with full authority to prescribe measures for the protection of city improvements.

15.24.110 - Repair of damage to city improvements.

In the event of damage to any street, curb, gutter, sidewalk, or any other public property incident to swimming pool construction, the building inspector shall cause such work as may be necessary to restore the improvements to as good a condition as the same was prior to such damage, and shall charge the cost thereof to the contractor to whom the permit was issued for the particular construction job. Such work may be performed by local contract or by city forces as deemed most economical and appropriate by the building inspector. Such damages as occur may be recovered from the cash bond or other indemnification security as required in this chapter.
