15.06.010 - Building code.

Pursuant to provisions of section 50022.2 of the government code of the state of California, the city council of the city of Chowchilla does hereby adopt by specific reference thereto and incorporation herein by said reference, the provisions, rules, and regulations specified as set forth in the currently adopted California Building Code Section 21, Section 10 of Chapter 28 of Title 15, including Appendix Chapters, included in the California Code of Regulations Title 24, California Building Standards Code, copies of which are on file in the community and economic development department, for public record and inspection. These are adopted by said city council by reference as the building code of the city of Chowchilla and made part of this chapter as though set forth in full, subject, however, to the amendments, additions, deletions, and the exceptions as set forth in this chapter.

The currently adopted California Building Code is based on the currently adopted International Building Code as published by the International Code Council (ICC) as adopted and amended by the California Building Standards Commission in the currently adopted California Building Standards Code of the currently adopted California Code of Regulations Title 24, together with all appendices. These are hereby adopted by reference as the building code, and made part of this chapter as though set forth in full, save and as set forth such portions as are amended, deleted, or added to as set forth in this chapter.

15.06.020 - Violation—Penalty.

A. It shall be unlawful for any person, firm, or corporation, to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish, equip, use, occupy, or maintain any building or structure in the city, or use or permit the same to be done, contrary to or in violation of any of the provisions of the California Building Code or this chapter. The building official or his/her authorized representative shall issue a citation for an infraction, unless a determination has been made by the city attorney that a misdemeanor charge is not appropriate.

B. Except as otherwise provided, a violation of any provision of this chapter is deemed a violation under the provisions of the city of Chowchilla Administration Citation Ordinance (Title 1, Chapter 1).

C. Nothing in this chapter precludes the city of Chowchilla from using any other available methods to enforce provisions of this chapter including, but not limited to, initiation by the city attorney of any civil or criminal actions.

15.06.030 - Amendments.

The CBC adopted by this chapter is amended and changed as set forth in Section 15.06.040 and 15.06.050.

15.06.040 - Building permits, fees, applications, and inspections

The provisions for building permits, fees, schedules, and all matters relating to permits shall be as set forth herein or in the latest resolution of the city council establishing a schedule of fees and charges.

15.06.050 - Permits required.

Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit.

15.06.060 - Seismic zoning requirements.

A. Wherever Uniform Building Code refers to and/or otherwise references seismic zoning, such seismic zoning for the city, except for critical structures, shall be Seismic Zone 2, and all rules, regulations, ordinances and codes shall be interpreted in accordance with Seismic Zone 2 as defined in the Uniform Building Code.

B. Critical structures shall remain Seismic Zone 3 as presently provided in the Uniform Building Code.

C. Critical structures shall include the following:

  1. A structure occupied for any of the following uses: hospital, fire station, school or college, radio station, television station, microwave station, telephone and telegraph communication;

  2. A structure with an occupant load exceeding two thousand, the failure of which exposes its occupants to danger;

  3. A structure exceeding three hundred thousand occupant-hours during a calendar year and exceeding an occupant load of three hundred, the failure of which exposes its occupants to danger;

  4. A structure, the failure of which severely impairs the ability of the community to respond in an emergency.

D. The city engineer shall review each structure for which the classification is not certain and determine whether or not it is sufficiently similar in character and use to the critical structures set forth herein to be classified as a critical structure. Their determination shall be final.
